ORDER:
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.
2. Learned counsel for the petitioner submitted that rowdy sheet was opened against the petitioner in the year 2008 on the basis of eleven cases and all of them ended in acquittal. The petitioner is a fruit vendor by profession and since 2008 his name has been shown in the rowdy sheeters list of the Shahalibanda Police Station. Since 2014, the petitioner is not involved in any criminal case. It is further submitted that the petitioner made a representation dated 28.08.2021 to remove his name from the rowdy sheeters list.
3. In the counter filed by the respondent No.5, it is stated that the petitioner was involved in 12 cases. It is necessary to keep a watch on the activities of the petitioner keeping in view his past criminal antecedents. The rowdy sheet was opened against the petitioner vide proceedings No.27/OW/ACP-DVFN/08 dated 12.07.2008 in larger public interest. The police are entitled to review the case on month to month basis to watch the activities of the rowdy sheeter/suspect sheeter even if there is no case against them. The petitioner is an associate of notorious rowdy sheeters viz. Fayaz and Ayub Khan. The police have acted in accordance with the order No.601 of Police Manual and opened the rowdy sheet against the petitioner. There is no interference by the police with the personal life and liberty of the petitioner as alleged in the affidavit filed in support of the writ petition.

Taking into consideration the facts and circumstances of the case, this Court is of the opinion that the writ petition can be disposed 2 of directing the respondent No.4 to pass orders on the representation dated 28.08.2021 submitted by the petitioner for removal of his name form the rowdy sheeters list taking into account his criminal antecedents and acquittal in several criminal cases wherein the petitioner was involved and also the parameters in the Order No.601 of Police Manual. The said exercise shall be completed within a period of two (2) months from the date of receipt of a copy of this order.
Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
