THE petitioner has filed this petition under
Section 278 of the Indian Succession Act (in short "the
Act") for grant of Letter of Administration to the estate of
(Late) Ms. Nergish Mehta.
[2] According to the petitioner, (Late) Shri
Dossabhai Aderjee Mehta was a resident of Billimora in
Gujarat, and later shifted to Ahmedabad. (Late) Shri
Dossabhai had six sons and three daughters. His eldest son
was Erachshah Dossabhai Mehta (Kerawala), thereafter
Jehangirji Mehta, and then Darashaw, Framroz, Ratanshaw
and Homi and daughters names were Dina, Banoo and
Allan. The Family Tree has been annexed with this order.

[3] Shri Erachshah established the business of
consumer items at Indore. Shri Erachshah had four Children
two sons (Kersy and Homi) and two daughters (Jeru and
Nergish). Shri Erachshaw died on 16.08.1962 and was
survived by his two sons and two daughters. Kersy
Erachshah Mehta (Kerawala), Homi Erachshah Mehta
(Kerawala), Jeroo Erachshah Mehta (Kerawala) & Nergish
Erachshah Mehta (Kerawala).
[4] Shri Erachshah had made a "Will". Probate of
the said Will was granted by this Court on 17.02.1969 and
the property of Late Shri Erachashah devolved in
accordance with the said Will and probate upon his wife,
sons and daughters. The list of assets, the equity shares and
unclaimed dividends owned by Erachshah, his wife, sons
and daughters individually and in joint names are described
in Schedule attached hereto.
[5] That Nergish being the last of the surviving
descendant after demise of her widowed sister Jeroo
inherited all the dividends and moneys and other accounts.
[6] That Nergish being a Parsi, the distribution of
her estate would be governed by Chapter-III, Part-V of the
Act. That the division of property of Nergish who was a
spinster never got married, and died intestate at Indore on
20.08.2011 leaving neither lineal descendants, nor a
widower, the next of kin set forth in Part-II of Schedule-II
of the Act shall be entitled to succeed to the whole of the

property described herein below. The petitioner and the
Respondents No. 2 to 5 being the next of kin inherit the
property that was last owned by Nergish before her death.

(ii) Mehramai, the wife of (Late) Erachshah
and the mother of Nergish, for her investments
used different variation of names, viz. (a)
Mehramai Erachshaw Mehta; (b) Mehrabai
Erachshaw Mehta; (c) Mehramai Mehta; (d)
Mehramai Erachshaw Kerawala; (e) Mehramai
Kerawala; (f) Mrs. E Dossabhai; (g) Mrs.
Erachshaw Dossabhai and (h) Smt. Dossabhai E.
(iii) That Kersi, the son of (Late) Erachshah
and Mehramai being the brother Nergish, for his
investments used different variation of names, viz.
(a) Kersi; (b) Kersi Kerawala; (c) Kersi Mehta and
(d) Kersi Erachshaw Mehta.

(iv) That Jeru, the daughter of (Late)
Eruchshaw and Mehramai being the sister of
Nergish, for her investments used different
variation of names, viz. (a) Jeru Eruchshaw Mehta;
(b) Jeru Eruchshaw Kerawala; (c) Jeru Keki
Madan; (d) Jerubai Keki Madan; (e) Jeru K.
Madan and (f) J. K. Madan.
(v) That Keki R. Madan, (Late) husband of
Jeru, for his investments used different variation of
names, viz. (1) K R Madan and (b) Keki R Madan.
(vi) That Homi, the son of (Late) Erachshah
and Mehramai being the brother Nergish, for his
investments used different variation of names,
viz.(a) Homi Eruchshaw Mehta; (b) Homi
Eruchshaw Kerawala; (c) Homi Mehta and (d)
Homi Kerawala.
(vii) That Nergish for her investments used
different variation of names, viz. (a) Mehta
Nergish; (b) Mehta Nergish Eruchshaw; (c) Nergish
Eruchshaw; (d) Nergish Kerawala; (e) Nergish
Mehta; (f) Nergish Eruchshaw Mehta; (g) N. E.
Mehta and (h) Nergish E. Mehta.
[7] That Shri Erachshah during his lifetime
purchased land being Plot No.3/3 New Palasia, Indore, and
built a house thereon numbered as Bungalow No.37 and
named as "Meher Niwas". Shri Erachshaw also purchased
about 3 Acres agricultural land at Village Rau and other
properties at Ujjain and Surat.
[8] As explained in the Family Tree, the
petitioner, his brother Minu and sister Hillu, Ratanshah's
widow Khorshed Mehta and Roshan Tangra qualify at Serial
No.4 of Schedule-II, Part-II of the Act and inherit the
property.

[9] After filing this petition, Respondents No.2
to 8 appeared before this Court through their counsel and it
was submitted that they have no objection to the grant of
Letter of Administration to the petitioner.
[10] Notice of this petition was published in Daily
Newspapers having circulation in State of Gujrat and
Madhya Pradesh.
[11] On 23/07/2012, Pawansut Grih Nirman
Sahkari Sanstha through President Subhash Joshi filed an
objection in regard to maintainability of the petition before
this Court. According to them, it should have been filed
before the District Judge. It is also objected that in absence
of "WILL", Letter of Administration cannot be granted.
[12] In view of this objection, the petitioner has
filed an application to bifurcate the Rau property as the Rau
has been claimed by the Respondents, as they have
purchased this property from (Late) Ms. Nergish Mehta
during her lifetime.
[13] This Court vide order dated 28/04/2014,
allowed the application (I.A.No.6455/2012 ) in following
terms:-
"(i) That the permission to bifurcate the Rau property
without abandoning the claim of Letters of
Administration with respect to the property No.IV and
specifically land situated at Rau, Indore be granted to the
applicant with a leave to file the said application with
other evidences, documents and orders in respect of the
said property at a later date.

(ii) However, it is made clear that the right of the
applicant to seek any order qua the property situated at
Rau in which the objector claims some interest, will only
be subject to final orders passed by this Civil Court qua
the interest of the objector, if any in that property, which
order shall also be subject to all other relief as available
to the parties concerned in accordance with law.
(iii) As far as the objector is concerned, he has no
objection if the applicant wishes to participate in the
proceedings undertaken by the objector qua that
property under Order 9, Rule 13 C.P.C. or other
proceedings as may be required."
[14] In the light of this order, the petitioner has
filed an application for amendment in the petition and
bifurcate the Rau property without abandoning the claim of
Letter of Administration, in respect to the property.
[15] This Court relying the Full Bench decision of
this Court in the matter of Nawal v/s Jagdeesh Prasasd ,
reported in 1998 ILR 441, held that, the District judge has
no jurisdiction to grant probate when the value of the
property beyond the limits of State is in excess of Rs.Ten
Thousand only. In the present case, the petitioner has
pleaded that immovable assets in form of a land and
building is located at Ward No.12/1113 Wanki Bordi,
behind Dr. Bhakka Dispensary, Surat, is valued about
Rs.Fifty Lakhs. In view of this fact, the District Judge,
Indore has no jurisdiction to grant Letter of Administration,
in respect of the property at Surat. Hence, the present
petition is maintainable before this Court.
[16] This Court has also held that the petitioner
has come up with the plea of grant of Letter of

Administration, in case of properties of Ms. Nergish
Eruchshah Mehta, who was a 'Parsi' stated to have died
intestate, therefore, under Section 278 of the Act, the
petition for Letter of Administration is maintainable.
[17] To establish the relationship between
petitioner and deceased Ms. Nergish, petitioner examined
himself and three witnesses viz. Smt. Khorshad Ratanshah
Mehta; Shri Bhaktiar S. Bhesania (PW-2) and Shri Keki
Dorabji Dastoor (PW-3). The uncontroverted testimony of
these witnesses is natural and convincing, hence, it is
reliable.
[18] The petitioner has succeeded in proving that
he is the son of (Late) Shri Darashaw Dossabhai Mehta,
who was the brother of Erachshaw Dossabhai Mehta, and
would, therefore, be the Lineal Descendant of the
grandparent (paternal) Dossabhai Aderjee Mehta. The
petitioner and his brother Shri Minoo (the Respondent No.
2) and sister Smt. Hillu (the Respondent No. 3) qualify as
heir because the uncle (Kaka) Jehangir ji married but died
issueless and Framroz ji and Homi ji died bachelors and
issueless. That (Late) Ratanshaw is survived by his wife
Smt. Khorshed (PW-1) and only daughter Katy (Respondent
No 4) married to Babu Surendran. Smt. Khorshed has stated
that the daughters of (Late) Shri Dossabhai Mehta Mrs.
Dina and Mrs. Banoo both married, died issueless and Mrs.
Allan died leaving one daughter namely Mrs. Roshan
Tangra (Respondent No. 5).
[19] The petitioner has proved that at the time of

death, Nergish Erachshah was seized and possessed the
property shown in the schedules.
[20] That Yezdi Homi Kapadia, Gev Homi
Kapadia and Nina Shapoorji Daboo (Respondent Nos. 6, 7
& 8 respectively), all of Surat, Gujarat, fall in Clause 7 of
Part-II, Schedule-II and, therefore, do not qualify as heirs
as per Chapter-V of the Act and do not inherit any part of
the estate of the deceased.
[21] The petitioner and his brother Minoo
Darashaw Mehta and Sister Hilloo Neville Patel, alongwith
Mrs. Khorshed Ratanshaw Mehta, whose inheritance goes to
Katy Babu Surendran and Roshan Burjor Tangra fall prior
in the order set forth in Part-II of Schedule-II, and,
therefore, they being the next of kin, qualify as heirs to the
estate of Nergish inherited by her from her father Shri
Erachshaw Dossabhai Mehta and Mother Mehramai
Erachshaw Mehta, according to the Family Tree, which has
been exhibited as Exhibit P-4, by Keki Dorabji Dastoor,
Parsi Priest Udvada (PW-3) and by Bakhtiar Shapurji
Bhesania, Solicitor as Exhibit P-1, and again exhibited by
the Petitioner as Exhibit P-869.
[22] Jehangir D. Mehta, B.Sc., L.L.B., M.E.P.
(IIM-Ahmedabad), the petitioner is competent to administer
the Estate of the deceased Nergish as stated by the witness
Smt. Khorshed, Shri Bhaktiar and Shri Keki Dorabji
Dastoor, the Parsi Priest of Udwada.
[23] The petitioner and the Respondents No.2 to 5

succeed equally to the estate (property) of (Late) Nergish
and the property be so distributed that each of them receive
equal shares.
[24] As aforesaid, the petitioner is entitled for
Letter of Administration in respect of the estate of deceased
Nergish, excluding the land at Rau bearing Khasra
No.686/4/1/1, 688/4/1/1 & 688/5 admeasuring 1.892
Hectare.
[25] It is, therefore, ordered that Letter of
Administration be issued in the form set forth in Schedule-
VII and Section 290 of the Act. Before issuing the Letter of
Administration in form set forth in the Schedule, the
petitioner is required to file in the Court a valuation of the
property in the form set forth in the III Schedule of the
Court fees Act and the said valuation has to be verified by
the Collector keeping in view the provisions under Section
19 (H) of the Court fees Act. Two months' time from the
date of order is fixed for the petitioner to get the valuation
of property finalized and pays the Court fees mentioned in
Article 11 of the 1st Schedule of the said Act, on such
valuation.
[26] The petitioner will execute the administration
bond with one surety as provided under Section 291 of the
Act for the due performance of the estate of deceased
Nergish.
[27] The petitioner will be required to furnish full
and true inventory within 6 months from the grant of Letter
of Administration and true account of the property within 1

year from the date of grant of Letter of Administration as
provided under Section 317 of the Act. The petitioner will
remain bound by the Letter of Administration.
With the aforesaid directions, the petition
stands disposed of.

That Yezdi Homi Kapadia, Gev Homi Kapadia and Nina Shapoorji Daboo, all of Surat, Gujarat, fall in Clause 7 of Part II, Schedule II and therefore do not qualify as heirs as per Chapter V of Indian Succession Act 1956.
