HON'BLE MR. JUSTICE ASHOK KUMAR GAUR Order 13/12/2019 Learned counsel for the petitioner submitted that the controversy involved in the present writ petition is about treating the petitioner as Disqualified Directors under Section 164(2)(a) of the Companies Act, 2013. The petitioner has also sought direction to use his Director Identification Number (DIN) and Digital Signature Certificate for the purpose of filing his return.

Learned counsel for the petitioner submitted that the Division Bench of this Court in DB Civil Writ Petition No.4062/2019 (Narendra Kumar Jat Vs. Union of India) has already passed interim order and directions have been given to reactivate the Director Identification Number (DIN) and further Digital Signature Certificate is required to be issued in the capacity of the Director to file necessary annual returns to discharge statutory obligations of all the other companies, wherein the petitioner is Director.

This Court, as an interim measure, directs the respondents to reactivate the Director Identification Number (DIN) (Downloaded on 17/12/2019 at 09:56:54 PM) (2 of 2) [CW-20243/2019] of the petitioner and Digital Signature Certificate to enable the petitioner to file necessary annual returns and also to discharge his statutory obligation.

The interim order, passed by this Court, will remain subject to final outcome of the present writ petition.

Let the case be listed before the Division Bench. Learned counsel for the petitioner is directed to file additional copy of the writ petition enabling Registry to list the matter before the Division Bench.
