Learned advocate Mr.M.S. Trivedi appearing for the petitioner states that decision of this Court in Special Civil Application No.3638 of 2013, which had, if not identical, at least similar facts, is under consideration before the Hon'ble the Apex Court. The learned advocate for the petitioner is ready to rest contented on a statement being made or a direction being issued by this Court that outcome of that SLP in that matter will govern the facts of the present case.
2. The request is reasonable. The respondent-authorities are directed to apply the same decision which may be rendered by the Page 1 of 2 C/SCA/999/2014 ORDER Hon'ble the Apex Court in the Petition for Special Leave to Appeal (Civil) (CC) No.21478 of 2013 (arising from the judgment and order 10.07.2013 of this Court in Special Civil Application No.3638 of 2013). With these observations this petition is disposed of. Notice is discharged.
A copy of judgment and order passed in Special Civil Application NO.3638 of 2013 is placed on record by learned advocate Mr.M.S. Trivedi. A copy of order in Petition for Special Leave to Appeal (Civil) (CC) No.21478 of 2013 dated 03.02.2014 is placed on record by learned Central Government Counsel Mr.Ravi Karnavat. The same are taken on record.
