CRIMINAL PETITION No.1578 of 2020
ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.5 seeking to grant anticipatory bail in the event of his arrest in Crime No.29 of 2020 on the file of Jubilee Hills Police Station, Hyderabad, registered for the offences punishable under Sections 370 and 294 read with Section 109 IPC.
2. The case of the prosecution is that on receiving credible information, on 12.01.2020, the Sub-Inspector of Police, Jubilee Hills Police Station, reached the Affairs Pub located at Road No.10, Jubille Hills and found that bar dancers supplied by one person by name Prasad were performing dances obscenely in order to attract the male crowd to the party organized by one Srinivas Naidu and the owner of the pub by name Santosh Reddy and its Manager-the present petitioner and that the accused have been allowing the dancers to perform dances obscenely even knowing that it is illegal.
3. Heard learned counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner submitted that the petitioner is not at all the Manager of the said pub; that there is no nexus between the petitioner and the said pub; and that one Rohit Reddy in connivance with the Police falsely involved the petitioner in this case; Learned counsel further submitted that the petitioner is a permanent resident of Kukatpally, Hyderabad; that he is a law abiding citizen 2 and is ready to abide by any conditions that may be imposed by this Court in the event of his enlargement on anticipatory bail
5. Learned Additional Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner.

As seen from the contents of the F.I.R., there are specific allegations against the petitioner that he being the Manager of the aforesaid pub allowed the dancers to perform dances obscenely in order to attract male persons, which is an illegal act thus looking into the nature of allegations levelled against the petitioner, I am not inclined to grant anticipatory bail to the petitioner.
7. The Criminal Petition is accordingly dismissed. However, the petitioner is directed to surrender before the Court concerned within ten days from the date of this order and move an application for bail, upon which, the Court below may consider the same and pass appropriate orders in accordance with law on the same day, after giving due notice to the learned Public Prosecutor concerned.
8. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
