1. Learned counsel appearing for the petitioner submits that the application filed by the petitioner under Order 39 Rule 2(A) of CPC is pending consideration before the trial Court since 08.05.2018 and there is no progress till date, therefore, trial Court be directed to decide the same expeditiously.

2. I have heard learned counsel for the petitioner.

3. The prayer is fair and reasonable.

4. Be that as it may, the trial Court is directed to expedite the proceedings initiated under Order 39 Rule 2(A) of CPC and conclude it within a period of four months from the date of receipt of copy of this order.

5. With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).

6. A copy of this order be sent to the trial Court directly as well as through the concerned District Judge for needful and compliance.
