1. None appears nor is any representation made on behalf of the applicant to press this bail application when the case is called out.

2. It transpires from the record that the applicant is in jail since 03.01.2026. Hence, the Court proceeds to consider and hear the bail application of the applicant with the assistance of the State 2 counsel.

The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of regular bail, as he has been arrested in connection with Crime No.07/2026, registered at Police Station City Kotwali, Ambikapur, District Sarguja (C.G), for the offences punishable under Sections 303(2), 111 of BNS.

The case of the prosecution, in brief, is that on 31.12.2025, the complainant Neeta Singh parked her Activa scooter near the Blood Bank and went for work, but upon returning in the evening, she found that the scooter had been stolen by an unknown person. On the basis of her report, an offence was registered and during investigation, the police examined the CCTV footage installed at the spot, in which a man was seen stealing the scooter. The said person was identified as the accused, Vidhyadhar Das. Thereafter, on 03.01.2026, the police apprehended the accused near Asola petrol pump while he was found moving on the stolen scooter. The vehicle was seized from his possession and in his memorandum statement, the accused admitted the commission of the offence. During investigation, sufficient evidence was found against him and it was also revealed that he has multiple criminal antecedents. Consequently, after completion of investigation, charge-sheet has been filed against the accused. Hence, the bail application. 3

5. The learned counsel for the State opposes the bail application and submits that the charge-sheet has been filed in the present case. She further submits that the applicant is alleged to have committed theft of the complainant's Activa scooter from near the Blood Bank and was subsequently found in possession of the stolen vehicle. He was identified through CCTV footage, apprehended by the police, and the stolen scooter was recovered from his custody. Furthermore, the applicant admitted the offence in his memorandum statement, so far as criminal antecedents of the applicant are concerned, the applicant has 17 criminal antecedents, out of which, details of 16 cases are, Section 138 Electricity Act - 2015 (Kanpur, U.P.), Section 453 IPC (house- trespass) - 2017 (Barabanki, U.P.), Sections 323, 341 IPC (hurt & wrongful restraint) - 2017 (Sikar, Rajasthan), Sections 323, 382 IPC (hurt & robbery) - 2019 (Jhunjhunu, Rajasthan), Section 379/34 IPC (theft with common intention) - 2019 (Churu, Rajasthan), Sections 420, 467, 468 IPC (cheating & forgery) - 2021 (Azamgarh, U.P.), Sections 457, 380 IPC (house-breaking & theft) - 2022 (Ambikapur, C.G.), Section 379 IPC (theft) - 2022 (Ambikapur, C.G., Crime No. 582/2022), Kidnapping case - 2022 (Achhalda/Araria, U.P., Crime No. 56/2022), Section 379 IPC (theft) - 2022 (Ambikapur, C.G., Crime No. 1040/2022), Section 379 IPC (theft) - 2022 (Ambikapur, C.G., Crime No. 1052/2022), Section 379 IPC (theft) - 2023 (Ambikapur, C.G., Crime No. 306/2023), Sections 323, 504, 506 IPC (hurt, insult, intimidation) - 4 2023 (Gonda, U.P.), Section 379 IPC (theft) - 2023 (Manipur P.S., Crime No. 240/2023), Section 379 IPC (theft) - 2023 (Manipur P.S., Crime No. 41/2023) and Sections 115(2), 351(3) BNS (assault-related offences) - 2024 (Bahraich, U.P.), as such, the applicant is a habitual offencer and his bail application is liable to be rejected.

6. I have perused the case diary.

From perusal of the record, it prima-facie appears that the applicant is alleged to have committed theft of the complainant's Activa scooter from near the Blood Bank and was subsequently found in possession of the stolen vehicle, the applicant was identified through CCTV footage, apprehended by the police, and the stolen scooter was recovered from his custody. Furthermore, the applicant admitted the alleged offence in his memorandum statement, also considering the fact that the applicant has 17 criminal antecedents, out of which, details of 16 cases are, Section 138 Electricity Act - 2015 (Kanpur, U.P.), Section 453 IPC (house-trespass) - 2017 (Barabanki, U.P.), Sections 323, 341 IPC (hurt & wrongful restraint) - 2017 (Sikar, Rajasthan), Sections 323, 382 IPC (hurt & robbery) - 2019 (Jhunjhunu, Rajasthan), Section 379/34 IPC (theft with common intention) - 2019 (Churu, Rajasthan), Sections 420, 467, 468 IPC (cheating & forgery) - 2021 (Azamgarh, U.P.), Sections 457, 380 IPC (house-breaking & theft) - 2022 (Ambikapur, C.G.), Section 379 IPC (theft) - 2022 (Ambikapur, C.G., Crime No. 582/2022), Kidnapping case - 2022 5 (Achhalda/Araria, U.P., Crime No. 56/2022), Section 379 IPC (theft) - 2022 (Ambikapur, C.G., Crime No. 1040/2022), Section 379 IPC (theft) - 2022 (Ambikapur, C.G., Crime No. 1052/2022), Section 379 IPC (theft) - 2023 (Ambikapur, C.G., Crime No. 306/2023), Sections 323, 504, 506 IPC (hurt, insult, intimidation) - 2023 (Gonda, U.P.), Section 379 IPC (theft) - 2023 (Manipur P.S., Crime No. 240/2023), Section 379 IPC (theft) - 2023 (Manipur P.S., Crime No. 41/2023) and Sections 115(2), 351(3) BNS (assault-related offences) - 2024 (Bahraich, U.P.), which shows that the applicant is a habitual offencer and has misused the liberty of bail granted to him earlier, also also in light of the judgment rendered by the Supreme Court in Deepak Yadav v. State of Uttar Pradesh & Another, reported in (2022) 8 SCC 559, wherein the Hon'ble Supreme Court had cancelled the bail granted to the accused therein on the ground that the accused had previous antecedents, this Court is of the opinion that is not a fit case to enlarge the applicant on regular bail.

8. Accordingly, the bail application of applicant - Vidhyadhar Das, involved in Crime No.07/2026, registered at Police Station City Kotwali, Ambikapur, District Sarguja (C.G), for the offences punishable under Sections 303(2), 111 of BNS, is rejected.

9. Needless to say that the trial Court concerned is at liberty to proceed and concluded the trial expeditiously.
