Learned counsel for the appellant has been duly informed about the date fixed. Nobody has turned up. The sole appellant was reported to have expired wayback on 19.07.2012 but no application till date has been moved to bring on record his LRs.
Learned counsel for the respondent has also been duly informed but nobody has turned up.
Perusal of the paper book would reveal that suit filed by the plaintiff (respondent herein) for possession of the land in dispute was decreed by the trial Court on 26.11.1998. The appeal filed by the defendant (appellant herein) was dismissed on 12.01.2000 by the First Appellate Court. Thus, present RSA is against the concurrent findings of the Courts below.
As noticed earlier that the appellant had expired long back as per order dated 19.07.2012. None of his LRs have come forward so as to pursue this appeal. Even the counsel for the appellant is not coming forward despite notice 1 of 2 ::: Downloaded on - 19-07-2024 20:00:41 ::: Neutral Citation No:=2024:PHHC:087042 RSA No.1708 of 2000 -2- to him. The afore-said circumstances indicate that the appellant is no longer interested in pursuing this appeal.
Dismissed in default for want of prosecution.
