SHRI N.N. KRISHNADAS (PALAKKAD): Sir, the Cauvery water dispute is between Tamil Nadu and Karnataka, but Kerala is one of the interested States. It is also a border State in Cauvery river issue. Kerala contributes 20 per cent of the water into the river Cauvery and it is entitled to get a stipulated quantity of water.
The Government of Kerala has requested the Central Government to settle the issue so that an amicable division of water resources could be possible. The Chief Minister of Kerala has written to the Prime Minister several times urging him that there should not be any unilateral announcement of the scheme without taking into consideration the consent of the State of Kerala.
Now, reports have appeared that Central Government is going to convene a meeting of the representatives of the States of Tamil Nadu and Karnataka to discuss this issue. Sir, I would like to bring to the notice of this Government that any decision without the involvement of the State of Kerala will not solve the problem. Therefore, I would urge upon the Central Government to convene a meeting of all the concerned States and solve the issue amicably taking into account the interest of all concerned States including the State of Kerala. SHRI VAIKO (SIVAKASI): Sir, the Government of India has committed a grave mistake by not notifying the scheme, by not formulating the scheme, by not obliging the commitment which was given by the Government of India or by the Attorney-General of India before the Constitution Bench of the Supreme Court 16 months ago. The Government of India has miserably failed... (Interruptions)

SHRI VAIKO (SIVAKASI): Sir, the Government of India has failed to honour the commitment... (Interruptions)

SHRI VAIKO (SIVAKASI): Sir, the Government of India should have notified yesterday itself to implement the Interim award of the Tribunal. There is no need for any more negotiations.
They took time. That took place. Finally, the Supreme Court came to the conclusion. Then, Sir, without honouring the commitment given to the Supreme Court...
MR. CHAIRMAN (SHRI P.M. SAYEED): What do you want the Government do?
SHRI VAIKO (SIVAKASI): Sir, I am coming to that. Sir, a grave injustice has been done to the people of Tamil Nadu and to the State of Tamil Nadu. This is not a matter of one State or two States. It is about the authority of the Central Government. It is about the authority which should be executed which they should do as a Central Government. It is a dangerous signal for the future unity and integrity of this country. Therefore, Sir, I oppose this attitude of this Government. The previous UF Government betrayed the Tamils.

SHRI VAIKO (SIVAKASI): Both the Chief Ministers of Tamil Nadu and Karnataka played a dubious role.(Interruptions)

SHRI MURASOLI MARAN (MADRAS CENTRAL): Sir, the hon. friends there have forgotten the facts. The draft scheme about Cauvery waters was finalised by the UF Government. The credit goes to the UF Government. Now the point is, the Government should come to a decision. I know it is a very difficult matter. So many States are involved. Kerala is involved. Karnataka is involved. They cannot come to a firm decision. Why are they adopting dilatory tactics? Therefore, today they have sought an adjournment in the Supreme Court. So, I condemn the dilatory attitude of the Government and we walk out.

SHRI K. KARUNAKARAN (THIRUVANANTHAPURAM): My demand is that the Government should not take any decision without consulting Kerala and without the consent of the people of Kerala. If they take any decision without the consent of the people of Kerala, Kerala will react on this.
SHRI JAYARAMA I.M. SHETTY (UDUPI): The people of Karnataka have been deprived of Cauvery water for several years. If you go to the ground reality, more than 64 per cent of the catchment area is in Karnataka. The people of Tamil Nadu have been using 205 tmc. of water. They have been taking advantage of the present situation. They have been taking advantage of the Parliament. They have been taking advantage of the situation. We, the farmers of Karnataka, have been suffering the maximum by yielding to Tamil Nadu for the last 10 years. I would request the Government through the hon. Chairman to protect the interests of the farmers. It is a very grave issue. It cannot be solved on the floor of the House. The interest of the State of Karnataka should be protected. श्री मुलायम सिंह यादव (सम्भल): सभापति जी, अब मंत्री जी की तरफ से इसका जवाब आ जाना चाहिए। संसदीय कार्य मंत्री तथा पर्यटन मंत्री (श्री मदन लाल खुराना): सभापति जी, कावेरी रिवर डिस्प्यूट के बारे में अभी हल नहीं निकला है।

(व्यवधान) श्री लालू प्रसाद (मधेपुरा) : सभापति महोदय, ११ महीने में संविद सरकार फेल हो गई। इनको उसके घोर नतीजे भुगतने पड़ रहे हैं। यह सरकार भी इस प्राबलम को सॉल्व नहीं कर पा रही है। अब इनको भी इसके नतीजे भुगतने पड़ेंगे। इनका भी वही हाल होने वाला जो पहले की सरकार का हुआ।

(व्यवधान) श्री शैलेन्द्र कुमार (चैल) : सभापति महोदय, हम आजादी की पचासवीं वर्षगांठ मना रहे हैं। फिर भी हम जातिवादी व्यवस्था से पिस रहे हैं। देश की सवर्ोच्च न्यायिक प्रणाली पर इस प्रकार के सवालिया निशान लग रहे हैं जो खतरे की घंटी है। मैं आपका ध्यान इलाहाबाद की स्थानीय निचली आदालत की तरफ आकर्िषत करना चाहूंगा। श्री बी. प्रसाद अपर जिला जज इलाहाबाद का दूसरी ब्रांच में ट्रांसफर हुआ। वहीं पर नियुकत श्री अशोक कुमार श्रीवास्तव ने पूरे चैम्बर को गंगा जल से धुलवाया जो बड़े शर्म की बात है। श्री बी. प्रसाद अनुसूचित जाति के अधिकारी थे। यह बहुत गम्भीर मामला है। जब श्री बी. प्रसाद ने इसकी प्रशासन से शिकायत की तो श्री बी. प्रसाद का स्थानांतरण दो वर्ष के अन्दर मैनपुरी कर दिया गया। वे हार्ट पेशेंट हैं जिनका इलाज जसलोक अस्पताल में चल रहा है। मैं माननीय प्रधानमंत्री जी से मांग करुंगा कि इस मामले की गंभीरता को देखते हुये इसे उच्चतम न्यायालय को रैफर किया जाये ताकि श्री बी. प्रसाद को किसी तरह से संरक्षण मिले और उनका स्थानान्तरण निरस्त हो। चूंकि मैनपुरी से मुम्बई के लिये कोई सीधी गाड़ी नही है और मुम्बई में उनका इलाज चल रहा है, उनकी दशा की गंभीरता को देखते हुये आपसे मांग करता हूं कि श्री बी. प्रसाद से मकान खाली न कराया जाये।
श्री मुलायम सिंह यादव (सम्भल): सभापति महोदय, जब किसी अधिकारी या न्यायाधीश का स्थानान्तरण हो जाता है तो दफतर को गंगा जल से धुलवाया जाता है। यह छूआछूत की मानसिकता है। आज हम देश की स्वतंत्रता की स्वर्ण जयन्ती मनाने जा रहे हैं और गांधी जी के नाम पर जा रहे हैं और इसके लिये लड़ भी रहे हैं। इसीलिये वुमैन्स बिल पर जोर दे रहे हैं। सभापति महोदय, जो मामला उठाया गया है, वह अत्यंत ही गंभीर मामला है। इस बात को नोटिस में लिया जाये। सरकार द्वारा इस मामले में कया कार्यवाही की जा रही है? अगर ज्युडशियरी में इस तरह से होगा कि यदि एक चैम्बर से दूसरे चैम्बर में यह कहकर कि दलित है, बदला जायेगा और गंगा जल से धुलवाकर दफतर को पवित्र किया जायेगा, यह न किया जाये। सभापति महोदय, इस मामले में आप रूलिंग दीजिये। सभापति महोदय : मैं डायरेकशन नही दे सकता। श्री मुलायम सिंह यादव (सम्भल): सभापति महोदय, आप इस मामले को गंभीरता से लीजिये।

(व्यवधान) सभापति महोदय : यदि आप सब खड़े हो जायेंगे तो कैसे चलेगा? श्री राजेश पायलट (दौसा) : सभापति जी, आपने जो सवाल उठाया है इसके लिए सरकार से यह पूछ सकते हैं। दफतर को धुलवाने में कोई दिककत नहीं है, कोई भी उसको साफ करवा सकता है, लेकिन गंगाजल से धुलवाना और उसका प्रचार करना, यह भावनाओं से खेलने वाली बात है। सरकार इस पर रिपोर्ट मंगाये। ऐसी चीजों की शुरूआत तो होती है, लेकिन अंत बहुत बुरा होता है।

(व्यवधान) श्री राजेश पायलट (दौसा) : मैंने माननीय सदस्य की भावना सुनी है, जिसमें उन्होंने बताया कि बिना किसी बात के इलाहाबाद हाई कोर्ट के जज का स्थानान्तरण हुआ और उनकी जगह दूसरे जज आये और अपने दफतर को गंगाजल से धुलवाया। अनुसूचित जाति के जज ने मुख्य न्यायाधीश उच्चतम न्यायालय को शिकायत की। सभापति महोदय, इसलिए यह मामला बहुत गंभीर है। सरकार से पूछा जाए कि कया यह सच है, यदि सच है तो इस मामले पर कया कार्रवाई की गई?

PREMAJAM (BADAGARA): Mr. Chairman, Sir, I may be permitted to speak. श्री वीरेन्द्र सिंह (मिर्जापुर): सभापति महोदय, ऐसी घटना नश्िचत रूप से खतरनाक है। यदि कोई इस तरह का काम करता है तो ठीक नहीं है। यह न्यायालय का मामला है और यदि न्यायालय में इस तरह की घटना हो जाए तो इसे कौन देखेगा, हम कहां जायेंगे? सभापति महोदय : इसलिए यह मामला श्री शैलेन्द्र कुमार जी ने उठाया। श्री वीरेन्द्र सिंह (मिर्जापुर): इसलिए मेरी आपसे प्रार्थना है कि आप इस पर कोई रूलिंग दें कि यदि इस तरह की घटना हो गई तो उसको कहां देखा जायेगा। अगर कोई छोटी जाति में पैदा होता है तो वह नीच और यदि कोई बड़ी जाति में पैदा होता है तो उच्च कहलाता हैं, कया यह उचित है? यह व्यवस्था हमारे यहां न रही है और न रहनी चाहिए। इस बारे में साफ-साफ सरकार द्वारा कोई निर्देश जारी किया जाना चाहिए कि इसके लिए कौन दोषी है और दोषी को कया सजा दी जानी है? सभापति महोदय : वीरेन्द्र सिंह जी, जीरो ऑवर में जो मुद्दे उठाये जाते हैं, उस पर सरकार के जो भी मंत्री हैं, वे नोट करते हैं। ऐसे मामलों में अगर कोई रीएकट करना चाहता है, वह रीएकट कर सकता है। यहां से बैठकर उनको डायरेकशन नहीं दी जा सकती है और आपको मालूम है कि यह कानून हमारे पास है। इसलिए शैलेन्द्र कुमार ने जीरो ऑवर में मेन्शन किया, सभा की जो प्रतक़िया है और मंत्री इसके बारे में नोट करेंगे। सभापति महोदय :

सभापति महोदय, इसी से जुड़ा हुआ एक और मामला है और वह है बिहार में जे.पी.यूनीवर्िसटी में १० दिन से ताला लगा हुआ है। वहां इसलिए तालाबंदी हुई है कि बिहार सरकार के जो निर्णय हुए हैं वे दूरदर्िशतापूर्ण नहीं हैं, अदूरदर्िशतापूर्ण हैं। जे.पी.यूनीवर्िसटी के कर्मचारियों का मासिक वेतन का भुगतान ९९ लाख रुपए होता है, लेकिन जो बिहार सरकार ने आदेश दिया था उसके अनुसार स्थानीय कालेज जगदम के २० कर्मचारियों का बकाया ८८ लाख रुपए का भुगतान हो गया और जो जून मास का बकाया ९९ लाख रुपए का भुगतान था वह नहीं हुआ। इसलिए मेरा कहना यह है कि एक ओर एक कालेज के कर्मचारियों की मांग मान ली जाती है और दूसरी ओर यूनिवर्िसटी के अन्य कर्मचारियों की वैसी ही मांग नहीं मानी जाती है। इसलिए जे.पी. यूनिवर्िसटी के लोग वहां तालाबंदी किए हुए हैं।

(Not recorded) श्री मोतीलाल वोरा (राजनांदगांव): माननीय सभापति महोदय, दिल्ली के सरकारी अस्पतालों के ग्रुप "सी" और "डी" के ७०,००० से अधिक कर्मचारियों की हड़ताल के कारण चकित्सा सेवाएं ठप्प हो गई है। कर्मचारी अपनी मांगों के समर्थन में २४ जुलाई तक हड़ताल पर रहेंगे। कर्मचारियों ने चेतावनी दी है कि यदि उनकी मांगें नहीं मानी गईं तो वे २५ जुलाई, १९९८ से अनश्िचतकालीन हड़ताल करेंगे। हड़ताल के कारण दुर्घटनाओं के शिकार व्यकितयों को भारी परेशानी का सामना करना पड़ रहा है। अस्पतालों में सफाई कर्मचारियों के हड़ताल पर रहने के कारण वाडर्ों में खून लगी पट्टियां, पेशाब की थैलियां और अन्य प्रकार की गंदगी बिखरी पड़ी है। केन्द्र सरकार हड़ताली कर्मचारियों की समस्या और मांगों का शीघ्रातिशीघ्र निवारण करे।
SHRI K. YERRANNAIDU (SRIKAKULAM): Mr. Chairman, Sir, it is a most important matter that I would like to bring to your notice. The Andhra Pradesh Government has written a letter to the hon. Prime Minister. I quote: -
"I would like to bring to your notice that in Andhra Pradesh, the A.P Intoxicating Liquors (Prohibition of Advertisements) Act, 1978 was brought into force from 1/10/1988. This legislation prohibits advertisements soliciting the use of or offering any liquor. However, time and again some of the liquor companies are utilising the electronic media in violation of the above legislation. I am sure you would agree with me that the use of electronic media for promoting alcohol is against the larger public interest."
