MAs filed by the applicants, under Rule 4(5)(a) of the CAT (Procedure) Rules, 1987 for joining together in their respective OAs, are allowed. The subject matter of all these OAs (batch matter) is one and the same and hence, as requested by the learned counsel for the respective parties, all the above OAs were heard together and this common order is being passed. However, for the sake of convenience, we have taken the facts from OA No.2048/2013 for consideration.
2. The Staff Selection Commission (SSC) vide its Notice of Advertisement published in the Employment News/Rozgar Samachar dated 24.03.2012 called for applications from the eligible candidates for recruitment to different posts through the Combined Graduate Level Examination 2012 (in short `CGLE, 2012).
3. Some of the relevant instructions issued under the aforesaid Notice are extracted hereunder:
COMBINED GRADUATE LEVEL EXAMINATION, 2012 IMPORTANT INSTRUCTIONS TO CANDIDATES
1. Commission will be holding Combined Graduate Level Examination, 2012 for recruitment to different posts for which Graduation from a recognized University is the minimum Educational Qualification. The Examination will comprise of two Tiers of Written Objective Type examination followed by Computer Proficiency Test/ Interview/Skill test, wherever applicable as per the Scheme of Examination. Posts have been placed in two groups, inter-alia, based on their Grade Pay and papers in Tier II examination/Interview. Preference for Posts, is to be indicated in the application. Candidates are requested to note that preference for Posts once exercised will be final. Request for change of preference will not be considered under any circumstance. For the post of Assistant in CSS, candidate shall have not more than three attempts unless covered by any of the exceptions notified by Government of India.
2. In view of the huge number of applicants, scrutiny of the eligibility category etc. will not be undertaken at the time of Tier-I and Tier-II examination . Therefore, the application will be accepted provisionally only. The candidates are advised to go through the requirements of educational qualification, age, physical standards etc and satisfy themselves that they are eligible, before applying and before indicating their preference for any particular post. Copies of supporting documents will be sought only from those candidates who appear in Tier-II examination at the time of interview/skill test/document verification. Candidature will be cancelled if any information or claim is not found substantiated when the scrutiny of documents is undertaken by the Commission after Tier-II of the Examination. Commissions decision shall be final in this regard.

17. COMMISSIONS DECISION FINAL The decision of the Commission in all matters relating to eligibility, acceptance or rejection of the applications, penalty for false information, mode of selection, conduct of examination(s) and interviews, allotment of examination centres, selection and allotment of posts/organizations to selected candidates will be final and binding on the candidates and no enquiry/correspondence will be entertained in this regard.
18. COURTS JURISDICTION Any dispute in regard to this recruitment will be subject to courts/tribunals having jurisdiction over the place of concerned Regional/Sub-Regional Office of the SSC where the candidate has submitted his/her application.
19. For detailed instructions relating to Application form, instructions for filling up the application form and for on-line payment/submission of application , candidates are advised to refer Annexures-I, IIA and IIB.
4. In pursuance of the aforesaid Notification, the applicants applied for different posts for which they are eligible and appeared and participated in the selection process, as enumerated above, under the heading `Scheme of the Examination.
5. The respondent Staff Selection Commission (SSC) published the results of the CGLE, 2012 in the month of February, 2013. However, the result of the applicant was withheld without assigning any reasons. A list of 456 candidates, including the name of the applicant, was kept under withheld list vide Annexure A1, wherein no reasons were mentioned. Thereafter, a revised result list was issued on 30.05.2013 (Annexure A2), wherein a total number of 836 candidates, including the applicant, were kept under withheld category, again without assigning any reasons.
6. Subsequently, the applicant received a stereo typed, pre-printed Show Cause Notice dated 27.05.2013, wherein the name of the applicant was typed in the gaps meant for filling the name. The said impugned Show Cause Notice reads as follows:

Whereas Mr./Ms. ANIL KUMAR was provisionally called for Interview cum personality Test/CPT/DEST of the aforesaid Examination.
Whereas the Commission undertakes regular post-examination scrutiny and analysis of performance of the candidates in objective type multiple choice question papers with the help of experts, who have proven expertise in such scrutiny and analysis and had carried out such scrutiny and analysis in the case of written examination papers in Tier II of the aforesaid examination.
Whereas, as informed by SSC (Hqrs.), incontrovertible and reliable evidence has emerged during such scrutiny and analysis that Mr./Ms. ANIL KUMAR in association with other candidates who also took the same examination.
Hence, as directed by SSC (Hqrs.), Mr./Ms. ANIL KUMAR is hereby given an opportunity to show cause, within 10 days of issue of this notice, as to why his/her candidature should not be cancelled and why he/she may not be debarred for five years from appearing Commissions examinations due to his/her indulgence in unfair means in above mentioned examination.
If he/she fails to respond within prescribed time limit his/her candidature for above mentioned examination will be cancelled and he/she will be debared for five years from appearing Commissions examinations and thereafter no further correspondence will strictly be entertained.

7. The SSC, vide the said notice, without giving any details simply stated that in a regular post examination scrutiny and analysis of performance of the candidates in objective type multiple choice question papers with the help of experts, who have proven expertise in such scrutiny and analysis, incontrovertible and reliable evidence has emerged that the applicant had resorted to copying in the said papers in association with other candidates who also took the same examination. The SSC directed the applicant to show cause, within ten days of issue of the notice, as to why his candidature should not be cancelled and why he should not be debarred for five years from appearing Commissions examinations due to his indulgence in unfair means in CGLE, 2012.
8. In respect of some of the applicants in these batch of OAs such as OA No.2243/2013, in fact, the SSC initially, vide the result published in February, 2013, declared that the applicant was successful in the selection process and was selected for appointment as Sub-Inspector in Central Board of Excise and Customs and allotted to State of Madhya Pradesh, as per the preference exercised by the applicant and on availability of the said post, in accordance with his merit position. However, vide the revised results list of May, 2013, kept the name of the applicant under withheld category, and thereafter issued similar stereo typed Show Cause Notice.
9. The applicants in all the aforesaid OAs, are aggrieved with the similar Show Cause Notices (SCN), wherein the names of respective applicants only typed, without any change in the other contents. All the applicants questioned their respective impugned notices on various grounds inter-alia, violation of principles of natural justice and fair play.
10. This Tribunal at the time of issuance of notice, by way of an interim relief, directed the respondents not to pass any final orders in pursuance of the impugned Show Cause Notices. In respect of the applicants wherever they were initially declared selected and some post and cadre/department was allotted and thereafter their result was kept under withheld category and Show Cause Notices were issued, it was also further directed to keep one such post of the said cadre/department unfilled until further orders. Some of the applicants approached this Tribunal when their result was kept under withheld category and some approached after the issuance of Show Cause Notices, in pursuance of keeping their results under withheld category.
11. The respondent-SSC sought time to file their counter reply from time to time for about six months and finally when these matters were taken up for final hearing, Shri S.M.Arif, the learned counsel for the respondent SSC, without producing any written instructions, orally sought permission of this Tribunal to withdraw the impugned Show Cause Notices and to permit them to issue fresh Show Cause Notices indicating the specific instances of alleged copying/malpractice and reasons thereof. However, the learned counsel for the applicants have vehemently opposed the said request of the applicants, and insisted for hearing of the OAs on merits.
12. Heard all the learned counsel for the parties. In substance, the following submissions have been made on behalf of the applicants.
i) The impugned Show Cause Notice though does not mention any specific details to enable the candidates to submit effective and proper reply but indicated that impugned action is sought to be taken on the basis of a report by an Expert Committee. Even if a fresh Show Cause Notice is issued, giving the details which may be highly technical, the applicants who are in no way equipped with any information/knowledge about the technical process/method adopted by the said so called Expert Committee, would not be in a position to defend their case effectively. Therefore, even if a fresh opportunity is given to the applicants, it would be a futile exercise and still be violative of principles of natural justice.
ii) Since the issuance of a fresh Show Cause Notice and calling for fresh explanation from the applicants and passing of orders thereof would take a substantial time and hence the respondents should be directed to issue appointment orders to the applicants as per their merit position subject to result of the final orders to be passed by the respondents after issuance of fresh show cause notices and after completion of the inquiry thereto.
iii) The respondents have not produced any material against the applicants either through the Show Cause Notices or by filing any counter before this Tribunal and hence, no permission should be given to issue any fresh Show Cause Notices. Most of the applicants are unemployed youth and just completed their education and by virtue of fresh process of inquiry their career would be affected, and in any event, the subsequent examinations, i.e., CGEL, 2013, etc. should not be effected by virtue of the issuance of fresh Show Cause Notices.
iv) The respondents issued the stereo typed Show Cause Notices mechanically and without application of proper mind, by just filling the names and hence, the respondents should be directed to verify and scrutiny each case before issuing any fresh Show Cause Notice and if it is found that any of the candidates to whom impugned Show Cause Notices were issued, in fact, not indulged in any copying/malpractice they should be cleared, and should be appointed as per their merit.
v) The respondents should not be allowed to issue any fresh SCNs and they should be compelled to place the entire material which form basis for the Show Cause Notices, before this Tribunal and the same should be put to legal scrutiny by the Tribunal.
vi) The alleged Expert Committee basing on whose report the impugned action is initiated, should be defined and its constitution, procedure, and application should be put to legal scrutiny. Respondent-SSC is already having a full-fledged mechanism in the form of Invigilators, Flying Squads, etc. to check all types of malpractices, and when admittedly, nothing incriminating was alleged by the said machinery, the respondents should not be permitted to adopt any other method which is foreign to the present system of conducting examinations. The present alleged method of analysis and scrutiny by experts behind the back of the applicants would result in serious civil consequences on the applicants.
vii) About 9 to 10 lakhs of candidates appeared in the CGLE, 2012, and that there were no complaints of any sort of malpractice against any of the applicants. The alleged method adopted is illegal, arbitrary and without application of mind. The impugned Show Cause Notices were issued to some of the candidates who failed in the examination also which clearly indicate the mechanical approach of the respondents. Some of the applicants are already working and for their professional upgradation they have again appeared in the present CGLE, 2012 and because of the illegal action of the respondents basing on high handed and highly technical method adopted behind the back of the applicants, their entire life would be ruined.
13. In support of the contentions on behalf of the applicants, they have placed reliance on the Judgement of a Coordinate Bench of this Tribunal in OA No.1497/2012 (Rakesh Kumar Yadav v. Staff Selection Commission and Others) with OA No.2573/2012 dated 09.05.2013.
14. Per contra, Shri S.M.Arif, learned counsel for the respondent, appearing on behalf of the Staff Selection Commission, would submit that there is no illegality or irregularity in the method adopted by the respondent-SSC for identification of the copying/malpractice committed by the applicants. The Experts, who have proven expertise in the post-examination scrutiny and analysis of performance of the candidates in objective type multiple choice question papers, by using highly technical and sophisticated method found that the applicants have resorted to copying/malpractice. The respondents have followed uniform method in respect of all the applicants without any discrimination or deviation, and hence, the method adopted cannot be found fault with. He further submitted that, when the respondent-SSC, which issued impugned Show Cause Notices, itself intending to withdraw the same, the applicants cannot have any objection.
15. The learned counsel for the respondent-SSC placed reliance on the following Judgements:

Coordinate Bench Judgements of this Tribunal in Dinesh Kumar v. Staff Selection Commission & Others (OA No.1117/2013 dated 30.09.2013) and Dheeraj Singh v. Staff Selection Commission and Others (OA No.2588/2012 dated 30.09.2013).
A Coordinate Bench Judgement of this Tribunal at Chandigarh in Sahadev Hooda v. Union of India & Others (OA No.713-HR-12 dated 17.10.2012) and The Judgement of the Honble High Court of Punjab and Haryana in Union of India & Others, v. Sahadev Hooda & Others, in CWP No.24380/2012 dated 10.12.2012.
16. In Rakesh Kumar Yadavs case (supra), though the applicant secured more marks in Tier-I and Tier-II examinations, than the required cut off marks, and though fared well in the consequential Interview, in respect of CGLE-2011, instead of appointing him, the respondent-SSC issued the impugned Show Cause Notice by stating that his candidature for the exam is cancelled and further calling his explanation why he should not be debarred from all Commissions exams for a period of five years on the ground that the applicant was in possession of a mobile phone in the examination hall, which is violative of the instructions mentioned in the Advertisement. This Tribunal, after calling for the relevant records and having found that there is no noting or endorsement to the effect that the applicant indulged in any sort of malpractice including the possession of the mobile phone during any of the three stages of the examination, allowed the OAs quashing the impugned Show Cause Notice and the debarment order.
17. In Dheeraj Singhs case (supra), the respondent-SSC by issuing a Show Cause Notice dated 09.04.2012, cancelled his candidature for CGLE-2011 on the ground that he was in possession of a mobile phone in the examination hall and further asked him to show cause as to why he should not be debarred from Commissions exam for a period of five years. Without taking any decision on the reply submitted by him, again issued another Show Cause Notice dated 28.05.2012, stating that there is prima facie evidence to believe that he might have resorted to unfair means in the examination and, therefore, his candidature is cancelled and asked to show cause as to why he should not be debarred from the Commissions exam for a period of five years. On questioning both the SCNs by filing the OA, a Coordinate Bench of this Tribunal after considering various decisions including Yogender Singh, Varun Bhardwaj, Sahadev Hooda and Rakesh Kumar (supra) quashed the SCNs on the ground that they being violative of principles of natural justice. However, giving liberty to the Commission to give a proper SCN specifying therein the means used by the applicant in the examination, considered by the Commission as unfair means and pass a fresh order after receiving his response thereto. In Dinesh Kumar (supra) also this Tribunal considered similar facts in the similar circumstances and passed identical orders.
18. In Varun Bhardwaj (supra) he was one of the candidates for selection to the post of a Clerk in State Bank of India and for which he appeared for the examination held on 15.11.2009 which is an objective type test consisting of four Sections. The respondent No.1-SBI on the basis of a report given by the Institute of Banking Personnel Selection (IBPS) has denied appointment to the petitioner suspecting that unfair means were used by the petitioner inasmuch as wrong answers which are given by the petitioner tally with the wrong answers given by two other candidates, namely, Ms. Pooja and Ms. Rinku. It was admitted on behalf of Respondent No.1 that the petitioner was not directly caught in using the unfair means, however, the scientific consideration which is used by IBPS is applied by all Banks to ensure that whoever have indulged in malpractices should not be appointed in a Bank which deals with public moneys. For the better understanding the relevant paragraphs of the said Judgment are extracted as below:
3. D. Based on the scientific and theoretical method, which is time tested, for detection of use of unfair means, IBPS sent a report/analytical data of merit listed pairs of candidates established/suspected to have copied/used unfair means. So far as the Respondent is concerned, the said analytical data clearly showed that it was a case of use of unfair means being suspected. The Petitioner had indulged in using unfair means with 2 Candidates namely Ms. Pooja and Ms. Rinku. The basis of suspecting use of unfair means was that there were identical wrong answers (IWW) 6/7 (for 50 items test) in Marketing Aptitude/computer knowledge. Copy of the analytical data prepared by the IBPS, is annexed hereto and marked as ANNEXURE R-3.
E. It is relevant to point out at this stage that the said written test was held on All India basis. Based on the report of IBPS, the Respondent Bank has cancelled the candidature of 976 candidates who had appeared in the said test and which were cases of use of unfair means beyond reasonable doubt as well as cases where use of unfair means was suspected.
F. It is further relevant to state herein that even though the candidates suspected to have copied/used unfair means, were sitting at different venues/centres while writing the said test, it is a rampant practice wherein the candidate have been caught using mobile phone while attempting to answer the question papers. In fact, in the written test held at Hisar, Ludhiana and Karnal centres, the candidates were caught red handed discussing answers, while attempting to answer the question paper. In few cases, the candidates have confessed using the mobile phone/SMS the answers, even though they were sitting at different centres.
G. In the multiple choices objective type test used by IBPS there are 5 choices/alternative answers in each question out of which only one is the right answer and the other 4 are wrong answers. As far as possible all choices are made attractive enough, therefore, if the candidate does not happen to know the correct answer he would select one of the 4 wrong answers by chance. Thus, probability of picking a particular wrong answer is out of 4 or 1/4 or 0.25. Similarly, if the other candidate of the pair also does not happen to know the right answer to the same question he would also happen to select one of the 4 wrong answers. Therefore, the occurrence of one question with identical wrong answers by a pair of candidates will be =1/16=(1/4)2 =(0.25) 2. Similarly the probability of a pair of candidates having 2 question with identical wrong answers would be (0.252) 2=(0.25) 4.If it is continued in the same way, the probability of the pair making wrong answers to 12 question will be (.25) 24 i.e. 0.00000000000000035. The probability of the pair making 7 wrong answers will be (0.25) 14 i.e. 000000003 and 6 wrong answers will be (0.25) 12 i.e. 000000059. It means that one can be certain that such an event just cannot occur by chance.

4. A reference to the aforesaid paras shows that the respondent no.1 uniformly applies the scientific test as devised by IBPS to all candidates. It is not as if the petitioner or any other person is selected or targeted. The respondent, in para G has given the probability levels for a pair of candidates giving wrong answers simultaneously, and which are with respect to those questions where 5 similar choices are given. For two persons giving 6 wrong identical answers the probability is found to be (0.25)12 i.e.0.000000059. The petitioner Mr. Varun Bhardwaj is found to have 6 identical wrong answers with one candidate Ms. Pooja and 7 identical wrong answers with another candidate Ms. Rinku. With respect to a pair of candidates giving 7 wrong answers the probability is in fact much lesser i.e 0.000000003=(0.25)14.

In my opinion, Courts cannot sit as an expert body to decide the rational test which has been applied by institutions to find out use of unfair means, and this is because unfair means are on many occasions never found to have been caught red handed. Of course, it is possible that there may be the greatest possibility of a co-incidence of the petitioner not having used unfair means, however, once the respondent no.1 uniformly applies the IBPS test, Courts would prefer not to interfere for any one of the candidate who gives the examination inasmuch as this would mean to quashing of the application of the IBPS test which is used by the respondent no.1 bank which deals with public moneys. No doubt the petitioners argument that he was not sitting at the same centre with the other two candidates with whom the petitioner had same answers, and they were sitting at different centres in Delhi, but, in these days of technology and communications, some things do happen and therefore as long as the respondent No.1 is not acting arbitrarily there is no reason for the Court to interfere. The learned Single Judge of the Honble High Court of Delhi, finally held that once it is found that there is no discrimination against the petitioner inasmuch as the IBPS Scientific Test is uniformly applied by the bank, and also the fact that the probability is so negligible of various wrong answers being identical for a pair of persons inasmuch as five options are given in the objective type test, I do not feel in the facts and circumstances of the case that Courts should not substitute its own opinion for that of an expert body.
19. The case of Yogender Singh (supra), pertains to termination during probation on the allegation that he had indulged in malpractice during the recruitment/selection process, and hence, not applicable to the facts of the present case. The only similarity is that the SCN for termination was issued without any details of alleged malpractice, was quashed on the ground of violation of principles of natural justice.
20. Sahadev Hoodas case (supra) was originally allowed by the Chandigarh Bench of this Tribunal and later confirmed by the Honble High Court of Punjab & Haryana. When the applicants candidature was cancelled vide order dated 27.02.2012, the Chandigarh Bench of this Tribunal allowed the OA by giving liberty to the competent authority to proceed afresh but only after observing the principles of natural justice by affording an opportunity of hearing to the applicants. Thereafter, the competent authority issued show cause notice requiring the applicant to indicate why his candidature for the said examination should not be cancelled and further to show cause why he should not be debarred from appearing at any other examination for a period of five years held by the Commission. The applicant, by way of reply to the said Show Cause Notice, required the competent authority to indicate incriminating material which had impelled the issuance of the Show Cause Notice, but without furnishing any such material, orders of cancellation were passed. When the said orders came to be questioned again, the Tribunal, observed as under:
11. The position which surfaces during the course of hearing, can be summarized as under :
12. The applicant is a candidate who has been accused of having indulged in malpractices at the relevant examination process. The matter is averred to have been gone into by people with expertise in the context. However, the basis of the material forming the foundation of a finding against the applicant has not been notified to the applicant, even by being noticed in the impugned order.
13. While we do not claim locus to challenge the expertise-based process by the experts to conclude the relevant exercise, we are only on the observance of the principles of natural justice. For want of indication of the incriminating material, a candidate would not be able to offer any defence, much less valid, to the accusation which draws sustenance from the view obtained by experts in the exercise.
14. Mr. S.K. Ranjan, Deputy Director, Staff Selection Commission, North West Region, Chandigarh, has brought along a sealed envelope which, as per instructions from the higher authorities, contains the relevant material forming the foundational premise of the impugned order. The production of that documentation came to be ordered, vide orders dated 14.8.2012, in response to a verbal plea made by learned counsel for the applicant for grant of a direction to the respondents to that effect.
15. In view of the conceded position that the incriminating material never ever came to be put to the applicant herein, we do not propose opening the sealed cover for perusal. and accordingly allowed the OA quashing the impugned orders and granting once again an opportunity to the competent authority to proceed afresh, and further observed that However, we would pointedly make it clear that the liberty aforementioned, could be meaningfully utilized only if the competent authority is in a position to confront the applicant with the factual premise of the finding recorded by the Committee of experts for holding that the applicant had indulged in malpractice. It would be incumbent upon the competent authority to act faster in the matter and conclude the relevant exercise within a period of one month from the date of receipt of copy of this order. The said order was later upheld by the Honble High Court of Punjab and Haryana in CWP No.24380/2012, decided on 10.12.2012.
21. The Honble High Court of Delhi in Manish Dabas v. University of Delhi & Others, LPA No.39/2007 and batch decided on 04.07.2008, wherein also without there being any direct evidence of malpractice/copying, but by adopting a similar method wherein the candidates have no role, the respondent University debarred the petitioners, upheld the action of the University.
22. In the present case, the impugned Show Cause Notices do not indicate the details of malpractice committed by the candidate or what was the nature of copying indulged by the candidate. It is only stated that incontrovertible and reliable evidence has been emerged during the regular post examination scrutiny and analysis of performance of the candidate by the experts, who have proven expertise, that the candidates have resorted to copying in association with other candidates who also took the same examination. The respondents, though taken substantial time for filing counters but not chosen to file the same finally. Therefore, there is no occasion to this Tribunal to know what was the method adopted by the respondent-SSC, to come to the aforesaid conclusion on the conduct of the candidates. It is also not on record that a particular candidate committed the alleged malpractice individually or in association with any other candidate and if so, who is the said candidate and in what manner both of them done the mischief. Though the learned counsel for the respondents, vaguely submitted that the answer books of the candidates were compared with the answer books of other candidates by using highly technical and scientific methods and basing on the proportional similarities in giving right and wrong answers and also in not answering certain questions at all, neither he placed the so called specific procedure or method or modus operandi adopted by the Experts nor stated the specific malpractice/copying alleged to have committed by each applicant. In the absence of the same, this Tribunal cannot express any opinion on the validity or otherwise of the said modus operandi, said to have been adopted by the respondent-SSC. For all these reasons, the impugned Show Cause Notices being violative of principles of natural justice are liable to be quashed.
23. Equally, this Tribunal cannot express any opinion on the validity or otherwise of the vague allegations made against the candidates without giving any details in the impugned Show Cause Notices, for want of necessary pleadings.
24. All these OAs are pertaining to the CGLE-2012. The respondent-SSC has already conducted the CGLE-2013, and they may require to initiate process for the CGLE-2014 also in few months. It is not in any bodys interest to linger the selection process undecided, for a longer period. In the peculiar circumstances of the case, and to save valuable time of the candidates, and in the larger interest, we quash all the impugned Show Cause Notices issued for cancellation of the candidature of the applicants for CGLE-2012, and also for debarment of all Commissions examinations for a period of five years. However, liberty is granted to the respondents to issue fresh individual Show Cause Notices by giving full details of their alleged malpractices/copying and the detailed modus operandi adopted by the respondents in coming to the said conclusion and after considering the representations submitted thereto, and to pass appropriate speaking and reasoned orders in accordance with law. This exercise shall be completed as early as possible, but not later than, 60 (sixty) days from the date of receipt of a certified copy of this order.

After the aforesaid OAs were listed for pronouncement on 18.11.2013, and before pronouncement of the aforesaid Order on 18.11.2013, Shri Ajesh Luthra, the learned counsel for the applicants in some of the OAs, , submitted that the applicants in some of the OAs would like to withdraw their respective OAs as the Staff Selection Commission has published a list on 14.11.2013 and declared the result of cleared cases whose results were earlier kept withheld, and some of have been allotted the post and place of posting, including the applicants for whom he is appearing, therefore, he may be permitted to withdraw the said OAs. The learned counsel for the respondent-SSC did not object to the same.

In view of the aforesaid submission, and as the learned counsel for the respondent-SSC also not disputed the said fact, and since one of us [i.e., Shri V.N.Gaur, Member (A)]] was on leave, the pronouncement of the order was deferred to 22.11.2013 with a direction to the applicants counsel to file a Memo indicating the numbers of those OAs, on which the Order dated 14.11.2013 is having a bearing, on 18.11.2013 itself. Accordingly, the learned counsel for the applicants, Shri Ajesh Luthra, has filed the same, after serving a copy of the same to the opposite side, on 21.11.2013 vide Diary Nos.12396, 12399, 12400, 12397, 12398 and 12401, which are placed on record.

In view of the reasons mentioned in the aforesaid Memos, and a specific prayer made by them for withdrawal of the OA Nos. 2060, 2094, 2098, 2101, 2102 and 2238 of 2013, with liberty to approach this Tribunal, if need so arises, the same are dismissed as withdrawn with the liberty as prayed, and all the other remaining OAs are disposed of in terms of the directions passed in para No.24 above. Accordingly, we pronounced the order in all the aforementioned OAs today. No costs.
