CRIMINAL PETITION No.2956 of 2020
O R D E R:
This Criminal Petition is filed by the petitioners/accused No.2 and 3 under Section 482 of the Code of Criminal Procedure, 1973 seeking to quash the proceedings in FIR No.209 of 2020 on the file of Gudivada I Town Police Station, Krishna District. The offences alleged are under Sections 188, 270, 273, 328, 420 IPC, Sections 5, 22, 24(1) of COTPA Act and Section 3 of Epidemic Diseases Act, 1897.
2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor, appearing for the respondent/State.

During the course of hearing, the learned counsel for the petitioners as well as the learned Public Prosecutor have represented that the matter is surely covered by the common order of this Court, dated 05.03.2020 in Crl.P.Nos.5103 of 2020 and batch, wherein criminal proceedings initiated against the petitioners/accused therein are quashed to the extent of Sections 270,273, 328 r/w 34 IPC, Section 20(2) of COTPA 2003 and Section 59 (i) and (iii) of FSS Act, so also covered by the order passed in Crl.P.Nos.5421 of 2019 and batch, dated 18.12.2019 with regard to banned tobacco products.

Learned counsel for the petitioners also submits that in the present crime, FIR is quashed against Accused No.1 vide Crl.P.No.2674 of 2020, dated 23.07.2020 and against Accused Nos.4 and 5 vide Crl.P.No.2710 of 2020, dated 27.07.2020, hence, the proceedings against the petitioners in the present petition, who are A2 and A3 in the same F.I.R. are liable to be quashed.

Considering the above submissions, and in view of the earlier Judgments passed by this Court as stated above, the present criminal petition is allowed quashing the proceedings against the petitioners herein, in F.I.R.No. 209 of 2020 on the file of Gudivada I Town Police Station, Krishna District. As a sequel, the miscellaneous applications pending, if any, shall stand closed.
