Heard the parties.

A counter affidavit has been filed on behalf of the Director In- Charge, Forensic Science Laboratory, Patna.

Paragraph No. 3 of the aforesaid counter affidavit reads as follows:-

"It is humbly submitted that the sample exhibit related to Bathnaha P.S. Case No. 179/2020 has not been received in Forensic Science Laboratory, Patna or Regional Forensic Science Laboratory, Muzaffarpur till date."

The Superintendent of Police, Sitamarhi is directed to send a report as to how and why the viscera of the deceased has not been sent to the Forensic Science Laboratory though the case is of year 2020.

Let a copy of the order be communicated to the Superintendent of Police, Sitamarhi through FAX and e-mail forthwith.

Patna High Court CR. MISC. No.25229 of 2021(6) dt.23-03-2022 2/2 On being enquired, the Director In-Charge, Forensic Science Laboratory, Patna, has informed this Court that there is no facility for Narco Analysis Test in Bihar, but the Government is taking steps for creating and finalizing the educational qualification for persons who shall be appointed in the Forensic Science Laboratory for doing the Narco Analysis Test. On further being asked, he has informed this Court that it is pending in the Home Department since long.

The Secretary, Home Department, Government of Bihar is directed to send a report on the status of the appointment of an expert of Narco Analysis in the Forensic Science Laboratory.

Let a copy of the order be also communicated to the Principle Secretary, Home Department, Government of Bihar, and A.D.G. (C.I.D.), Government of Bihar through FAX and e- mail forthwith.

Personal appearance of the Director In-charge, Forensic Science Laboratory, Patna, is dispensed with for the present.

Put up this case on 30.03.2022 for further hearing.
