Order 04/01/2017 Counsel for the petitioner submits that the civil suit has been consigned to record and a liberty has been given to the plaintiff to move an application for restitution of the suit, in the event his appeal succeeds.
(2 of 2) Counsel for the petitioner states that the present writ petition be permitted to be withdrawn with the same liberty.
Consequently, the writ petition is dismissed as withdrawn, with liberty as prayed for. The stay application also stands disposed.
