Information sought:
The Appellant filed an (online) RTI application dated 28.04.2023 seeking the following information:
"खंडवा रे लवे टे शन दनांक 23/03/2023 को रे ल पु लस थाना आर पी एफ और रे ल शासन एंवम रे ल विजल!स "वारा "वारा रे ल ट#कट Page 1 of 5 अ%नय मतताओं को लेकर क) गई शु,ल रे ल ट#कट एज!सी खंडवा के व-"ध सम त काय/वाह1 क) मा2णत %त उपल5ध कराई जाए"
The CPIO furnished a reply to the Appellant on 26.05.2023 stating as under:
"उपरो,त वषयनुसार जनसूचना अ9धकार अ9ध%नयम 2005 के अ:तग/त आपके ;दारा तत ु आवेदन म! मांगी गई जानकार1 जनसूचना अ9धकार अ9ध%नयम 2005 के धारा 8 (1) (j) के अनुसार साव/ज%नक नह1ं क) जा सकती ।"
Being dissatisfied, the appellant filed a First Appeal dated 21.06.2023. The FAA vide its order dated 04.07.2023, upheld the reply of CPIO. Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.

The following were present:-
Appellant: Present through Video-Conference. Respondent: Shri Ashok Kumar, ASC & APIO present through Video- Conference.
The Appellant, during the hearing, reiterated the contents of his RTI application and instant appeal and submitted that till date information has not been provided to him by the Respondent.
Written submissions of the Respondent are taken on record and the same is reproduced hereinbelow:
"उपरो त संद भत प के अनुसार वषयां कत के संबंध मे स वनय अवगत कराना है क , आज #दनांक 19.11.2024 को $ीमान के&'(य सुचना आयोग, नई #द+ल( -वारा आयोिजत व/डयो कॉ&23 संग के दौरान मोह5मद उमर क अपील के मामले मे 6नद7 शत कया गया क , खंडवा रे +वे कोट म3 वचाराधीन संबि&धत मामले का वतमान ि;थती से अवगत कराये, िजसके अनुपालन मे =रपोट इस ?कार है क , आरपीएफ़ भुसावल मंडल -वारा #दनांक- 23/03/2023 को Page 2 of 5 6नर(Cक/CIB/भुसावल के 6नद7 शानुसार, 6नर(Cक आरपीएफ खंडवा एवं उप6नर(Cक ए. के. संह, ;टाफ के साथ एक संयु त ट(म गठHत करके सट( कोतवाल( थाना खंडवा से पु लस क मदद लेकर, शु ला रे +वे =रजव7शन ि;थत शॉप नं-222/23, सIजी मंडी ग+ल(, सनेमा चौक, खंडवा, िजला-खंडवा (MP) मे जाकर रे ल आरCण ई-#टक टL के अवैध Mयापार बाबत Mयि त नाम-दा6नश खान पता असलम खान उN 32 वष, पता- पटे ल आगरकर माग, हनफ म;जीद के पास, वाड नं 39, मकान नं.44, खंडया, िज-खंडवा (म.?) से पूछताछ करने पर उसके -वारा बताए गए पसनल ID danish7123 एवं shahim221 के माRयम से IRCTC के वेब साइड पर बक ु कये गये 02 Live रे ल आरCण ई #टक ट क मत-
2003.80/- Sपये व 28 नग परु ाने रे ल आरCण ई-#टक ट कमत 59069.50/- Sपये एवं उ त शॉप से 05 नग पूराने रे ल आरCण ई-#टक टL को और 01 नग पूराना Intex कंपनी मॉ6नटर कंमत अंदाजत 2000/- Sपये, 02 नग पूराना Assembled CPU कमत 12000/- Sपये, 01 नग पूराना Canon L-2900 मॉडल का ?ंटर कमत 3000/- Sपये, 01 नग पूराना Poco कंपनी मॉड मॉडल M-2 मोबाईल क मत 4000/- Sपये को उप6नर(Cक ए. के. संह -वारा पंचL के समC घटना ;थल जVती पंचनामा के तहत जVत कर आरपीएफ़ थाना खंडवा म3 मालमु-दे के साथ वापस आकर दो पंचो के समC उ त Mयि त का बयान दज कया गया। िजसमे उसने उपरो त पसनल ID के माRयम से IRCTC के वेब साईड पर से जXरतमंद Mयि तयL का रे ल आरCण ई-6तक ट 6नकालकर, #टक ट मू+य से अYधक 100-200/- S. Zयादा कमीशन लेकर उपलIध करवाकर रे ल आरCण ई #टकटो का अवैध Mयापार करने बाबत गुनाह कबूल कया और रे ल ?शास
-वारा जार( कोई वैधा6नक लायसे&स नह(ं होना बताया। िजस कारण उ त के वS-ध आरपीएफ़ पो;ट खंडया म3 CR NO- 431/2023, u/s-143 रे +वे ए ट के तहत मामला दज कर Yगर[तार कया गया था। मामले मे जांच अYधकार( उप6नर(Cक ए. के. संह
-वारा वYधवत कायवाह( करते हुये सबंYधतL के बयान दज कर एवं संबि&धत द;तावेजो को एक\ त कर मामले क जांच पूण क गई और शकायत प को #दनाक-11.07.2023 को मा. रे +वे &यायालय खंडया म3 पेश कया गया। मा. रे +वे कोट -वारा उ त ?करण के लए RCT No-1223/2023 #दया गया। उ त ?करण Page 3 of 5 अभी मा. रे +वे &यायालय खंडवा म3 वचाराधीन है । िजसमे अगल( सुनवाई #दनाक- 17.12.2024 को 6नधा=रत है ।"
The Respondent submitted that initially factual position in the matter has already been informed to the Appellant.
Decision:
The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records, observes that the Appellant in his second appeal is aggrieved that he is not satisfied with the reply provided by the CPIO. On the other hand, the Respondent contended that factual position in the matter has already been informed to the Appellant.
The Respondent, now at the stage of second appeal, has placed on record a revised reply in the form of written submissions before the Commission which in view of the Commission is an adequate response to the RTI application.
Further, the said written submissions of the Respondent are being treated as an updated reply to the instant RTI application which has not been shared with the Appellant yet. In view of this, the Respondent is directed to share a copy of their latest written submissions dated 19.11.2024 with the Appellant, within a week from the date of receipt of this order. No further intervention of the Commission is required in the matter.
The appeal is disposed of accordingly.
