W.P. Nos. 24171, 24176 and 24207 of 2018
COMMON ORDER:- (Per the Hon'ble Sri Justice Suresh Kumar Kait) Inasmuch as the question of fact and law involved in these writ petitions is one and the same, these matters are taken up together for disposal by this Common Order.
2. The learned counsel for the petitioners submits that the issue raised in the writ petitions is ceased by the Apex Court which fact is not disputed by the learned Government Pleader for Services appearing on behalf of the respondents.
3. The learned Government Pleader for Services has drawn the attention of this Court to the order dated 25.04.2018 in Conmt. Petition (C) No. 820 of 2017 passed by the Supreme Court whereby the Andhra Pradesh Public Service Commission was directed to revise the seniority list in respect of all the vacancies available and arising from 07.03.2002. Consequently, the respondents revised the list and submitted the same before the Supreme Court.
4. The case of the petitioners is that when the aforementioned direction was given by the Apex Court, the respondents were supposed to seek objections, however, no objections have been sought, as such, the petitioners are apprehending that the respondents may disturb their seniority. Subsequently, the Apex Court, vide its order dated 15.05.2018 in Conmt. Petition (C) No. 820 2 SKK,J & AKS,J WPs_24171 of 2018 and batch of 2017, while ordering notices in all fresh applications, gave liberty to the parties to file their objections before the next date of hearing i.e. 19.07.2018. In pursuance of the said direction, only some of the petitioners herein have filed their objections and the others have not yet filed.
5. The learned Government Pleader for Services submits that the other petitioners who have not filed objections are at liberty to file their objections, if any, as per the order of the Apex Court, and on such objections being filed, the respondents will consider the objections and apprise the same to the Apex Court in this regard.
6. In view of the factual situation, we are inclined to dispose of the writ petitions directing the respondents to retain and continue the petitioners in their respective posts.
7. With the above direction, the writ petitions are disposed of. No order as to costs.
8. It is needless to mention that this order will be subject to the outcome of the issue pending before the Apex Court.
9. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
