JUDGMENT
Dated this the 27th day of March, 2026
1. Petitioner is a person running a hotel business. The Petitioner has filed this Writ Petition highlighting the low percentage of allocation of LPG made to the hotel industry as per various orders passed by the State Government on account of the ongoing LPG shortage due to the war. The said Orders are challenged on the ground that the same are arbitrary, irrational and discriminatory.
2. According to the learned Counsel for the Petitioner, only 10% allocation is made to the hotel industry as of now, which is quite negligible.
3. The learned Government Pleader, on instructions, submitted that a new revised order has been passed by the Commissioner of Civil Supplies and Consumer Affairs on 24.03.2026, making 40% allocation to the hotel industry. It is also subject to change as per the change of situation.
4. The learned Counsel for the Petitioner submitted that, for the time being, the Petitioner is satisfied if direction is issued to ensure 40% allocation to the hotel industry.
2026:KER:27317 WPC No.12185 of 2026 4 Learned Government Pleader submitted that as of now, the Government is committed to ensure 40% allocation to the hotel industry. Hence, this Writ Petition is disposed of, recording the said submission of the learned Government Pleader that the Government will make a 40% allocation of the LPG to the hotel industry.
5. The learned Counsel for the Petitioner pointed out that the allocation to the hostels and educational institutions is not required during vacation, and it can be allocated to the hotel industry. It is open to the Petitioner to file a necessary representation to the appropriate authority of the State Government in this regard, and it is for such authority to consider the Representation in accordance with law.
