ORAL ORDER
28 07-05-2013Heard in part.
I.A. No. 3426 of 2013 has been moved by the Chief Secretary, Government of Bihar for modification of the order dated 6.5.2013 seeking dispensation of his personal appearance under the circumstances indicated in the said application.
I.A. is allowed with a clear understanding that his personal appearance may not be required provided the earlier direction of 6 Patna High Court CWJC No.10179 of 2007 (28) dt.07-05-2013 P6 / 6 the Court is carried out in letter and spirit without any excuse in this regard.
Yet another affidavit on behalf of the Principal Secretary, Education has also been filed wherein certain averments have been made trying to explain the circumstances under which earlier direction of the Court dated 6.2.2013 has not been carried out. Court is not concerned with those explanations but was interested in final outcome of the direction.
However, on an assurance duly extended by the Principal Additional Advocate General on the issue as a final indulgence, matters are directed to be listed on 2nd July, 2013.
Though there is no affidavit filed on behalf of the Principal Secretary, Finance, with regard to exemption but the Principal Additional Advocate General informs the Court that since he is unwell he could not appear.
Principal Secretary, Education appears whose appearance is dispensed with.
Chief Secretary may not be required to appear if the undertaking taken on his behalf with regard to earlier direction of the Court is carried out by the next date.
