JUDGMENT
Plaintiff in O.S.No.171 of 2007 of the court of learned Munsiff, Parappanangadi is the petitioner before me. In that suit he prayed for a declaration that the Hussain Madavoor Group in the Chenakkalangadi Sakha is entitled to manage affairs of that Sakha till final decision of the litigation regarding control and administration of the Society called 'Kerala Naduvathil Mujahiddeen' and for injunction restraining respondents and their men interfering with or obstructing administration and management of Chenakkalangadi Sakha, its institutions and properties of Hussain Madavoor Group. He also prayed for an order of interim injunction. Learned Munsiff granted interim injunction which the respondents challenged in C.M.A.No.16 of 2007. That appeal was allowed and the order of injunction was vacated. Petitioner challenged judgment in Civil Miscellaneous Appeal in W.P.(C) No.35052 of 2007 before this Court contending that civil court has no jurisdiction to entertain the suit and grant relief since the dispute is to be decided under the Wakf Act and Section 85 of that Act ousted jurisdiction of the civil court. This Court set aside the judgment in Civil Miscellaneous Appeal and restored interim order of injunction granted by the trial court. Thereafter the suit was tried and dismissed holding that the civil court has no jurisdiction (as the learned counsel for petitioner submits). The dismissal of the suit was challenged in A.S.No.136 WP(C) No.13520/2010 2 of 2009 of the Sub Court, Tirur. In that appeal petitioner obtained an order of injunction which the respondents challenged in F.A.O. No.80 of 2010. This Court did not interfere with the order of injunction but transferred the appeal to the Sub Court, Manjeri with a direction to dispose of the appeal before the court is closed for summer vacation. Learned Sub Judge dismissed the appeal on the day the court was closed for vacation. On the same day petitioner applied for carbon copy of the judgment and made Ext.P7, application to direct respondents to maintain status quo. Ext.P7, application was posted for hearing after vacation. Hence, petitioner was constrained to file this Writ Petition seeking reliefs. This Court passed an interim order of injunction on 20.04.2010. In the meantime, learned counsel for petitioner submits, a Second Appeal has been filed challenging judgment and decree in A.S.No.136 of 2009 renumbered as A.S.No.8 of 2010 of the Sub Court, Manjeri and an application for interim relief has been moved in the said appeal. It is the submission of learned counsel that the appeal and application are coming up for hearing in this Court on 24.05.2010. The request of the learned counsel is that until this Court disposed of the application for injunction in the Second Appeal, the interim order of injunction passed by this Court on 20.04.2010 may be kept alive. Learned counsel for respondents opposed the prayer contending that under cover of interim order of this Court petitioner is indulging a lot of mischief causing inconvenience to the petitioner.
2. It is not disputed that the Second Appeal preferred by the petitioner WP(C) No.13520/2010 3 and the application for interim relief are coming up for hearing on 24.05.2010. In that situation, there is no reason why the interim order passed by this Court should not remain in force till this Court considered the application for injunction in that Second Appeal.
3. Accordingly, it is directed that the interim order of injunction passed by this Court on 20.04.2010 will remain in force till 25.05.2010 or, this Court passed appropriate orders on the application for injunction made in the Second Appeal, which ever is earlier.
With the above direction this Writ Petition is disposed of.
