ORAL JUDGMENT
Date : 06-07-2018 Mr. Rajendra Prasad Singh, learned counsel for the petitioners is permitted to add Bihar Animal Science University as party respondent during the course of the day.
Heard Mr. Rajendra Parasad, learned counsel appearing on behalf of the petitioners and Mr. K. N. Singh, learned senior counsel appearing on behalf of the Bihar Agricultural as well as on behalf of the Animal Science University and the counsel for the State.
Mr. Rajendra Prasad Singh by placing reliance of the order passed by the co-ordinate Bench of this Court, whereby the writ court disposed of the writ application with a direction to the Patna High Court CWJC No.15426 of 2012 dt.06-07-2018 6/6 university to consider the case of the petitioner in the light of the judgment of the Apex Court in the case of Secretary State of Karnataka and Ors. Vs Umadevi and Ors. reported in (2006) 4 SCC 1, subsequent to the judgment of State of Karnataka and Ors. Vs. M.L. Kesari and Ors. reported in (2010) 9 SCC 247 submitted that the present writ application may be disposed of similar line.
In view of the above, the present batch of writ application are disposed of. The university is expected to take fresh decision on the claim of the petitioners for regularization in the light of the judgment of the Apex Court in the case of Umadevi and Ors. Vs. M.L. Kesari and Ors. at the earliest preferably within a period of six months from the date of receipt/production of a copy of this order.
With the aforesaid, the writ petitions stand disposed of.
