A letter was written by the villagers of Village Kashi Nagar, Kachauna, Tehsil Sandila, District Hardoi, which has been treated as a Public Interest Litigation and directions were issued to the respondents to file counter affidavit within a period of four weeks. Reply has been filed on behalf of respondents 3 and 4.
Learned counsel for respondents 3 and 4 points out that another writ petition, being Writ Petition No.11343/MB/2009, which has been filed by the Industry, whose closure was ordered pursuant to the inspection carried out by respondent no.2 is pending. We have been informed that the inspection was also carried out by respondent no.3. By an interim order granted by this Court, that closure of the Industry has been stayed.
Considering the controversy involved in the present case and as this is a letter addressed by the villagers, we appoint Mr. V.P. Nag, Advocate of this Court to act as Amicus Curiae.
Registry is directed to make available the copies of this writ petition along with all the replies filed as also Writ Petition No.11343/MB/2009 to Mr. Nag.
Those respondents, who have not filed their reply till date, will file the same within two weeks. Rejoinder affidavit, if any, will be filed within two weeks thereafter.
Place this matter after four weeks along with Writ Petition No.11343/MB/2009.
The Officers, who are summoned and are present before this Court today, need not to present again, as their presence is exempted until further orders of this Court.
