The petitioner is an accused for allegedly committing offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.

It is alleged that the petitioner has committed murder of the deceased.

Counsel for the petitioner submits that there is no eye witness to the said occurrence. He also submits that at best, if the allegation is taken to be correct, it will be a case under Section 201 IPC.

Learned Addl. P.P. opposes the prayer for bail of the petitioner but admits that no one has seen them assaulting the deceased but the witnesses have stated that the petitioner was carrying a dead body. He further submits that the petitioner has confessed his guilt before the police.

In view of the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner, namely Tura Sawaiyan, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Chaibasa, in connection with Tonto, Police Station Case No. 21 of 2014, corresponding to G.R. No. 559 of 2014 (S.T. Case No. 254 of 2014).
