The petitioners (Salesman/Field Officer) along with others had filed CWP No.9448 of 2016, seeking directions to the respondents to release the revised pay scales along with interest to the employees of the Marketing Societies merged with the Markfed as per the recommendations of the Fifth Pay Commission w.e.f. 01.01.2006. The said petition was disposed of by this Court vide order dated 22.09.2016 (Annexure P-1), with a direction to the respondents to make all efforts to decide the matter within a period of three months from the date of receipt of a certified copy of the order. Since the needful was not done within the stipulated time, hence the present contempt petition.

At the time of hearing, separate replies have been filed by the respondents, wherein it is submitted that the claim of the petitioners has been considered and the same has been rejected by passing a detailed speaking order dated 27.03.2017 (Annexure R-1).

1 of 2 ::: Downloaded on - 30-04-2017 19:40:43 ::: COCP No.575 of 2017 -2- Learned Counsel for the respondents submits that the present petition has become infructuous as the directions were to decide the matter, which stand complied with.

In view of the above, no further action is warranted. Accordingly, the present contempt petition stands dismissed as infructuous.

The petitioners are free to challenge the aforesaid speaking order in accordance with law.
