Heard learned counsel for the parties.

The petitioner apprehending his arrest in connection with the case registered under Sections 406/409/413/414/420/34 IPC has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case. The petitioner is the owner of one of the seized tractors, which was loaded with excess sand.

Learned A.P.P opposed the petitioner's prayer for bail. However, he has not disputed the said factual contentions of the petitioner.

Having considered the facts and circumstances of the case, the above named petitioner is directed to surrender before the concerned Court below within a period of two weeks. If he surrenders before the Court below within the aforesaid period, he shall be released on bail on furnishing bail-bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of the S.D.J.M, Bermo at Tenughat in connection with Mahuwatand P.S. Case No. 30/2016, corresponding to G.R. No. 718/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C and further that the petitioner shall deposit Rs.2,000/- in the Court below on the date of his surrender. However, the said deposit shall be made, subject to the result of the case.
