1. Heard Mr.J.P.Shah, learned advocate for the petitioner, and Mr.M.R.Bhatt, learned Senior Standing Counsel appearing on behalf of the respondent - revenue.
2. On going through the reasons recorded and the original assessment order dated 27th March, 2000 read with the return of income filed by the petitioner, it is apparent that prima facie, no omission or failure can be ascribed to the petitioner.
CSCA50732005N2 1 Admittedly, the impugned notice under Section 148 of the Income-tax Act, 1961 has been issued after a period of four years from the end of the relevant assessment order. In the circumstances, RULE. Interim relief in terms of Paragraph No.9.(C) of the petition.
