CRIMINAL PETITION NO.5021 OF 2021
ORDER:
This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (Cr.P.C.), is filed by the petitioner/A-1, for grant of bail in Crime No.308 of 2021 of P.S. Jagadgirigutta, Balanagar Division, Cyberabad, registered for the offences punishable under Sections 376(3), 354D, 354C, 452, 326, 506 and 384 of the Indian Penal Code and Section 5 read with Section 6 of the POCSO Act, 2012.
Heard the learned counsel for the petitioner/A-1, the learned Assistant Public Prosecutor representing the respondent-State and perused the record.
Learned counsel for the petitioner/A-1 would submit that the petitioner is innocent of the offence and he is no way concerned with the alleged offence. The petitioner is in judicial custody since 13.04.2021. The petitioner/A-1 is a law-abiding citizen and is prepared to abide by any condition which this Court may deem fit to impose in case of granting bail. Hence, he prayed to grant bail to the petitioner/A-1.
Learned Assistant Public Prosecutor representing the respondent-State opposed to grant bail to the petitioner/A-1.
Perused the record and other material papers, particularly the statement of the victim girl, who is aged about 15 years, wherein she has specifically stated that the petitioner is the son of the owner where the victim and her family are staying in the house as tenants and on and of the petitioner has sexually exploited her without her consent and also threatened her that he would 2 disclose the videos on social media if she would reveal the intimacy between the two to any of her family members. Subsequently, on 12.04.2021, he came to the house of the victim and provoked her to die and gave her pesticide and instigated her to commit suicide by consuming the said pesticide to which she has consumed the same and became unconscious. Thereafter, she has been admitted in the hospital for her treatment.
Thus, looking into the nature of allegations levelled against the petitioner and the commission of the crime which is heinous in nature, I am not inclined to grant bail to the petitioner/A-1.
The Criminal Petition is, accordingly, dismissed. Miscellaneous applications, if any, pending shall stand closed.
