2. These are applications filed by the Appellants under Sections 430 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking suspension of sentence of the Appellants during the pendency of the present appeal.

3. In CRL.A. 619/202, after some hearing, ld. Counsel for the Appellant wishes to withdraw the CRL.M.(BAIL) 997/2025 seeking suspension of sentence.

4. The same is dismissed as withdrawn at this stage. Accordingly, CRL.M.(BAIL) 997/2025 is disposed of.

5. In CRL.A. 834/2025, CRL.M.(BAIL) 1539/2025 and CRL.M.(BAIL) 178/2026 are applications for interim suspension of sentence for a period of 60 days. At this stage, the same are not pressed. Accordingly, the same are disposed of.

6. Accordingly, CRL.M.(BAIL) 1539/2025 and CRL.M.(BAIL) 178/2026 are disposed of.

7. In CRL.A. 834/2025 in CRL.M.A. 2751/2026 is the application for exemption. The same is allowed, subject to all just exceptions. Application is disposed of.

The present applications have been filed by the Appellants - Angel Gupta, Deepak, Shehzad Saifi and Dharmender under Section 430 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking suspension of sentence and release of Appellants on bail during the pendency of the present appeals.

10. On 29th October, 2018, Vide DD No. 6A information was received in P.S. Bawana that a shooting incident took place at around 7:00 A.M. at Dayal Vermi Compost between Dariyapur and Bawana, Haryana. It was stated that the deceased was riding her scooty and going to the school where she used to teach. The IO along with the crime team reached at the spot and inspected the crime scene. On the basis of the inspection, FIR No. 430/2018 was registered at P.S. Bawana under Sections 302/120-B/482/201/34 of the Indian Penal Code, 1860 (hereinafter, 'IPC') read with 25 and 27 of the Arms Act.

Thereafter, charges were framed against the Appellants.Pursuant thereto, the Trial Court had convicted the Appellants vide order on conviction dated 28th April, 2025 passed by the ASJ, Special Judge (NDPS), North, Rohini Courts, Delhi. for offences punishable under Section 120-B of IPC and 302 of IPC. Appellant- Shehzad Saifi and co-accused Vishal were also convicted for offences punishable under Section 25 and 27 of the Arms Act. Appellant- Dharmender was also convicted for offences punishable under Section 25 of the Arms Act 13.

This was followed by the order on sentence dated 30th April, 2025 passed by the ASJ, Special Judge (NDPS), North, Rohini Courts, Delhi vide which the Appellants were sentenced to undergo life imprisonment and fine CRL.A. 619/2025 & connected matters Page 4 of 8 This is a digitally signed order.

"Ends of justice would be served if CONVICT MANJEET SEHRAWAT, ANGEL GUPTA, DEEPAK, DHARMENDER, VISHAL @ JOHNY AND SHEHZAD are being sentenced as under:
1.) Under section 302 IPC- Sentenced to undergo life imprisonment (rigorous imprisonment) and to pay fine of Rs. 50,000/- each. In default of payment of fine, convict shall further undergo, simple imprisonment for one year.
2.) Under section 120-B IPC- Sentenced to undergo life imprisonment (rigorous imprisonment) and to pay fine of Rs. 5,000/- each. In default of payment of fine, convict shall further undergo, simple imprisonment for three months.

CONVICT DHARMENDER is additionally sentenced as under:

Under section 25 Arms - Sentenced to undergo simple imprisonment for 5 years and to pay fine of Rs. 2,500/-. In default of payment of fine, convict shall further undergo, simple imprisonment for two months. CONVICT VISHAL @ JOHNY AND SHEHZAD SAIFI are additionally sentenced as under:
Under section 25 Arms - Sentenced to undergo simple imprisonment for 5 years and to pay fine of Rs. 2,500/- each. In default of payment of fine, convict shall further undergo, simple imprisonment for two months. Under section 27 Arms - Sentenced to undergo simple imprisonment for five years and to pay fine of Rs. 2,500/- each. In default of payment of fine, convict shall further undergo, simple imprisonment for two months.
All the sentences shall run concurrently and benefit of section 428 CrPC shall be given to the convicts as per rules.
All convicts are also directed to pay compensation of Rs. 1 lakh each to children of deceased CRL.A. 619/2025 & connected matters Page 5 of 8 This is a digitally signed order.

Fine and compensation amount not paid. Fine deposited by the convicts shall be paid to the State towards the expenses borne by the State proceedings of this case."

13. The incident in the present appeals involved the demise of one lady- Ms. Sunita (hereinafter, 'the deceased'), who was the wife of Mr. Manjeet Sehrawat. Mr. Manjeet Sehrawat was alleged to be having an extra-marital affair with Ms. Angel Gupta.

The case of the prosecution is that, Mr. Manjeet Sehrawat with the aid of the step father of Ms. Angel Gupta i.e., Mr Rajeev Gupta and three other persons namely Mr. Shehzad Saifi @ Kalu, Mr. Dharmender and Mr. Vishal@ Johny had conspired to murder Ms. Sunita. The occurrence of the incident itself is admitted in as much as the shooting resulting in the death of the deceased. Mr. Rajiv Gupta i.e., the step father of Ms. Angel Gupta is presently undergoing trial and is under custody.

15. The submissions on behalf of the Appellants is that:

(i) The Appellants have served long periods of incarceration and the appeals may take some time to be heard.
(ii) In addition, it is also submitted by ld. Counsel for the Appellants that the role of Mr. Shehzad Saifi @ Kalu, Mr. Deepak and Mr. Dharmender is not fully established and they have played no active role in the killing of the deceased.

16. Heard. The Court has perused the evidence on record and role played by all the Appellants. The nominal roll of the Appellants would show that they have served five to six years approximately in custody. 17. Considering the periods of incarceration and the age of the accused as also the fact that the appeals may not be heard soon, the Court is inclined to suspend the sentences of the Appellants- Mr. Deepak, Ms. Angel Gupta, Mr. Shehzad Saifi @ Kalu and Mr. Dharmender in the following terms:

(i) The Appellants shall be released upon furnishing a personal bond for a sum of Rs.20,000/-, with a surety of the like amount, to the satisfaction of the Trial Court/Link Court.;
(ii) The Appellants shall stay in touch with the concerned IO and inform if there is any change in the address or in the mobile number.
(iv) The Appellants shall not leave the country without prior permission of the Trial Court;
(v) The Appellants shall provide their live phone numbers and residential address to the SHO, P.S. Bawana and regularly update the SHO about the change in address and phone number, if any;
(vi) The Appellants shall not, directly or indirectly, contact the family members of the deceased in any manner;
(vii) The Appellants shall report at the office of SHO, P.S. Bawana CRL.A. 619/2025 & connected matters Page 7 of 8 This is a digitally signed order.

18. The applications are allowed in the above terms and disposed of accordingly.

19. The observations made in this order shall not affect the final hearing in the appeal.

20. A copy of this order be communicated to the concerned Jail Superintendent for necessary information and compliance.

21. Order be uploaded on the website of this Court forthwith.
