Since the issues involved in all these OAs are identical, they are being disposed of by this common order. For the sake of convenience, we have taken the facts of OA No.695/2016.
2. MA Nos.688/2016, 712/2016 and 687/2016, filed for joining together, are allowed.
3. In pursuance of the notifications issued by the 1st respondent- New Delhi Municipal Council (NDMC), for filling up the posts of Teachers in NDMC/Navyug Schools, the applicants applied and participated in the consequential selection process. The 1st Respondent-NDMC, having satisfied that the applicants are possessing all the essential qualifications as per the unnotified rules, selected the applicants and appointed them as Guest Teachers in various NDMC Schools/Navyug Schools, for the academic year 2013-2014. The respondents engaged the applicants for the academic years 2014-2015 and 2015-2016 also, without putting them into any fresh selection. Accordingly, all the applicants have been working as Guest Teachers for the academic sessions of all these years.

The 1st respondent, vide the impugned Annexure A1 No.D- 117/Edn.Estt./2016 dated 29.01.2016 issued a public notice inviting online applications to form a panel of Guest Teachers for NDMC/Navyug Schools in various subjects for the session 2016-2017 for the posts of PGT, TGT, and Assistant Teacher (Primary and Urdu). It is stated in the said notice that all Guest Teachers working in any OA 695/2016 with OA 730/2016 and OA 696/2016 25 NDMC/Navyug Schools are also required to apply afresh for their consideration irrespective of their initial year of engagement. The respondents vide the said notice have prescribed a different criteria for selection, apart from requirement of elementary stage in the Central Eligibility Test (CTET), for the posts of Assistant Teachers (Primary) and TGT (various subjects/MIL). Aggrieved by the said action of the respondents in calling for fresh applications, by prescribing new selection criteria, and apprehending replacement by another set of Guest Teachers, the applicants filed the present OA, seeking the following relief(s):
(a) quash and set aside the impugned notice and circular placed at Annexure A/1 and Annexure A/2 respectively whereby the respondents have initiated the process of replacing the applicants by way of another set of Guest Teachers and consequently directed the applicants to apply for fresh consideration along with others.
(b) declare that the present applicants can be replaced only by regular selectees and upon principles of `last come first go' only and;
(c) direct the respondents to continue the present applicants on their contractual engagement as Guest Teachers in respective posts till such time regular selection is made;
(d) direct the respondents to accord age relaxation and appropriate weightage to the applicants in the event regular selection takes place;
(e) award costs of the proceedings and
(f) pass any other order/direction which this Tribunal deem fit and proper in favour of the applicant and against the respondents in the facts and circumstances of the case."

5. This Tribunal while issuing notices on 19.02.2016, observed that if the applicants apply in pursuance of the Advertisement/Notice the same shall be without prejudice to their rights. Further, after service of notices, and after hearing both sides, on 30.03.2016, the respondents were directed to maintain status quo with regard to the impugned Advertisement dated 29.01.2016.

Heard Shri Ajesh Luthra, the learned counsel for the applicants in OA No.695/2016 and OA No.730/2016 and Mrs. Rekha Palli, the learned senior counsel for the applicants in OA No.696/2016 and Shri Rajneesh Vats and Shri Vaibhav Agnihotri, the learned counsel for the respondents in all the OAs, and perused the pleadings on record.

It is submitted on behalf of the applicants that they are fully qualified and eligible for engagement as Guest Teachers and the respondents having satisfied themselves about the fulfilment of the essential qualifications selected and engaged the applicants initially for the academic year 2013-2014 and thereafter without putting them for any fresh selection reengaged them for the academic years 2014-2015 and 2015-2016. Though as per the settled principles of law, a set of Guest Teachers shall not be replaced with another set of Guest Teachers unless their performance is unsatisfactory, but with mala fide intention to replace the applicants with another set of Guest Teachers of their choice, the 1st Respondent-NDMC issued the impugned Notice not only calling for fresh online applications even from the existing Guest Teachers but also prescribed new selection criteria.

8. It is further submitted that none of the applicants' performance was either alleged to have been unsatisfactory or any notice or memo was issued to any one of them. The contentions raised in the additional affidavit filed by the respondents about the downgrading of the results, pertain to the Teachers who are working on regular basis but not against the applicants who are the Guest Teachers. The change of criteria is without support of any statutory rule and hence, impermissible. Calling for fresh applications for re-engagement is different from calling applications for fresh selection, which is also impermissible.
9. The applicants placed reliance on the following decisions in support of their contentions:
a) Dalip Kumar Jha and Ors. vs. New Delhi Municipal Council, Writ Petition (Civil) Nos.16499-16502/2004, decided on 01.09.2006 of High Court of Delhi.
b) Rajendra s/o. Vitthalrao Kamble v. Government of Maharashtra, Writ Petition Nos.5898, 7764, 9050, 9145 and 9160 of 2010, decided on 28.03.2012 of Bombay High Court (Aurangabad Bench).
c) Dr. Dinesh Vyas & Anr. v. University of Rajasthan & Ors., S.B.Civil Writ Petition No.12144/2012, decided on 14.11.2013 of High Court of Judicature for Rajasthan at Jaipur Bench.
d) Rakesh Kumar & Others v. Chief Secretary through Govt. of NCT of Delhi & Others, OA No.2452/2010, decided on 20.08.2010 of CAT, PB, New Delhi.
e) Mrs. Praveen Khan & Others v. Govt. of NCT of Delhi & Others, OA No.1184/2009, decided on 25.03.2010 by Full Bench of CAT, PB, New Delhi.
f) Sonalika Misra & Others v. Laxmi Mittal, Govt. of NCT of Delhi & Others, OA No.2671/2014 and batch, decided on 26.11.2014 of CAT, PB, New Delhi.

Per contra, the learned counsel for the respondents, while fairly stating that `a set of Guest Teachers may not be substituted/replaced by another set of Guest Teachers unless their services are found unsatisfactory,' however, submits that in view of the downgrading of OA 695/2016 with OA 730/2016 and OA 696/2016 28 the results of various Schools under their control for the years 2013- 2014 to 2015-2016, the respondents have thought fit that apart from selecting fresh Guest Teachers in the available vacancies, also decided to put the existing Guest Teachers for fresh selection as per the new criteria which is well within their power. It is further submitted that as per Delhi Gazette Notification dated 07.10.2011, only those who are qualified in elementary stage in the Central Eligibility Test (CTET), conducted by CBSE, will be considered for the posts of Assistant Teacher (Primary), and TGT (various subjects/MIL), though marks obtained in CTET will not be counted for preparation of the panel, and to implement the said requirement the impugned Notice is issued.

It is further submitted on behalf of the respondents that ordinarily, though, a set of Guest Teachers shall not be replaced by another set of Guest Teachers, unless their services are found unsatisfactory, however, there is no restriction from calling for fresh applications from the existing Guest Teachers. All the applicants whoever fulfils the requirements of the impugned Notice, shall be reengaged along with others, and hence, no existing Guest Teacher can take any objection to the impugned Notice.
12. It is further submitted that since the procedure provided in the impugned Notice is applicable to the existing Guest Teachers and to the fresh applicants equally and without any discrimination, it cannot be said that the impugned Notice is issued with mala fide intention.
OA 695/2016 with OA 730/2016 and OA 696/2016 29 They are required to issue the impugned notice since the available vacancies for the session 2016-2017 are more than the existing Guest Teachers.
13. They have placed reliance on the following decisions:
a) Naveen Sharma and Ors. v. GNCT of Delhi and Ors., OA No.2210/2015 of the CAT, PB, New Delhi, decided on 27.08.2015
14. Since it is not in dispute about the principle that `a set of Guest Teachers may not be replaced with another set of Guest Teacher unless their performance is unsatisfactory', we are not burdening this Judgement by discussing the decisions propounding the said view.
15. Further, it is not the case of the respondents that they have issued any specific notice or memo to any of the applicants calling for their explanation about their unsatisfactory performance. Further it is also not the case of the respondents that the unnotified Recruitment Rules, which were in existence in the year 2013 and in terms of which the applicants were selected and appointed as Guest Teachers, were amended in the interregnum, requiring any additional qualifications for the notified posts. It is also not the case of the respondents that they are filling up the vacancies by way of regular recruitment, as against the contract basis. Even the requirement of elementary stage in the CTET was in existence from the year 2011 onwards. On the other hand, it is the case of the applicants that all of them are possessing the said CTET qualification, as on today.

In the backdrop of the aforesaid facts and law, we are of the view that the respondents cannot put the applicants for fresh selection for engagement for the academic year 2016-2017, and accordingly, they are directed to engage the applicants and other Guest Teachers for the academic year 2016-2017 also, irrespective of the fact that they applied or not in pursuance to the impugned Notice, as the same is not a simple notice calling for applications for re-engagement but it is a notice for fresh selection with new criteria. However, the respondents are at liberty to disengage the services of any specific Guest Teacher, if his/her services are unsatisfactory, after following due procedure. They are also at liberty to engage any fresh candidates as Guest Teachers, who are selected as per the impugned Notice, after exhausting the engagement of all the existing Guest Teachers, if there are still vacancies. Accordingly, the OAs No.695/2016 and 730/2016 are allowed as indicated above. No costs. OA No.696/2016:
17. In addition to the facts and submissions made in OA No.695/2016 and OA No.730/2016, the respondents vehemently opposed this OA on the ground of jurisdiction. It is submitted by the respondents that the applicants are working as Guest Teachers in Navyug Schools being run by Navyug Education Society, which was not notified under Section 14(2) of the Administrative Tribunals Act, 1985 and also placed reliance, on a Coordinate Bench decision of this Tribunal.

It is not in dispute that the applicants, in this OA, have applied as Guest Teachers for the academic session 2013-2014, in pursuance of an advertisement issued by the respondent-NDMC and were selected and appointed in a selection conducted by the NDMC. They filed the present OA questioning the impugned Annexure A1 Notice dated 29.01.2016, issued by the respondent-NDMC, having aggrieved by the action of the NDMC in forcing them to apply afresh. The cause of action for this OA arose when the 1st Respondent-NDMC issued the impugned Notice. Hence, their working in Navyug Schools cannot take away the jurisdiction of this Tribunal against the impugned action of the respondent-NDMC which is well within the jurisdiction of this Tribunal. In this view of the matter, we do not consider it necessary to deal with the contentions of both sides with regard to the jurisdiction of this Tribunal against Navyug School Society.
19. Since the other facts and issues in this OA are identical with that of OA No.695/2016 and OA No.730/2016, this OA No.696/2016 also disposed in terms of the directions issued in para 16 above. No costs.
