01. 1. Heard the learned counsel for the Petitioners and the State.
2. This is an application for bail U/s. 438 Cr.P.C. filed by the Petitioners in apprehension of arrest for their alleged involvement in the offences U/s.419/420/120-B of IPC and Sections 66(C) & 66(D) of the Information Technology Act, 2000 in connection with CT Case No.371 of 2023 arising out of Baliapal PS Case No.138 of 2023 pending in the court of learned JMFC, Basta.
3. It is alleged that the accused Petitioners along with his associates fraudulently made online transactions with various innocent persons including the present complainant and deceived them by sending cyber links and obtaining OTP generated from their Mobile Phones with various false pleas, such as of rectification of relevant documents, etc. and thereby the Petitioners could manage to debit / Page 1 of 2 // 2 // Signature Not Verified Digitally Signed Signed by: ANANTA KUMAR PRADHAN Designation: SR. 4. Keeping in view the nature of allegations against the Petitioners, gravity of the offence, the facts and circumstances of the case, this court is not inclined to grant anticipatory bail in favour of the Petitioners. Accordingly, the prayer for bail stands rejected and the ABLAPL is dismissed.
