WRIT PETITION No.15264 of 2019
ORDER:
This Writ Petition is filed for the following relief:
"... to declaring the action of the respondent not extending the benefit of weightage marks as per notification though the petitioner discharged as contract Field Assistant for the period of 4 years 8 months on contract basis as highly illegal ..."
The case of the petitioner is that, he was appointed as Field Consultant in the Office of Assistant Director of Horticulture at Kurnool under State Horticulture Mission on contract basis; he worked in the same post from 13.10.2006 to 13.06.2011 and subsequently he worked as Horticultural Supervisor from 26.02.2018 to 25.02.2019 in A.P.C.R.D.A. at Vijayawada; in view of the said experience he is eligible for appointment to the post of Village Horticultural Assistant; pursuant to the notification dated 26.07.2019 issued by the 3rd respondent, for the posts of Village Horticultural Assistants (VHA), he applied for the same, appeared for the written examination and got 43.25 marks; as per para 15 of the said notification 10% weightage marks will be given to the candidates who rendered service as MPEO/MIAO/FIELD Consultant and Outsourcing Horticulture Officer in the Department of Horticulture; as the petitioner worked as Field 2 KVL, J W.P.No.15264 of 2019 Consultant in Horticulture Department he is fully eligible and entitled for weightage marks for the post of VHA; but the respondents are not extending the said benefit to the petitioner; the petitioner submitted a representation to the 6th respondent on 22.09.2019 along with experience certificate issued by the competent authority, but no action has been taken by the respondents. Hence, the Writ Petition.
Learned counsel for the petitioner submits that in the application which the petitioner filed pursuant to the notification, he has specifically mentioned that he is eligible for service weightage marks, in view of his previous experience.
The learned Government Pleader basing on instructions submits that, the petitioner did not opt for service weightage marks.
In view of the facts and circumstances of the case and in view of the submissions of the counsel for the petitioner, that in the online application petitioner has specifically opted for service weightage marks, the respondent Nos.4 and 5 are directed to look into the application, examine the same and take appropriate action strictly in accordance with law, as expeditiously as possible, preferably within a period of two (02) weeks from the date of receipt of a copy of this order. 3
KVL, J W.P.No.15264 of 2019 Accordingly, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
