1. Exemption is granted, subject to all just exceptions.

2. The Petitioner shall file legible and clearer copies of exempted documents, compliant with practice rules, before the next date of hearing.

4. The present application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (erstwhile Section 438 of the Code of Criminal Procedure, 1973) seeks pre-arrest bail in proceedings arising from This is a digitally signed order.

5. The case of the prosecution is based upon a complaint lodged by the complainants, who are practising advocates. The complainants, Mr. Jaikush Hoon and Ms. Archana Hoon, alleged that they were induced by the accused persons, including the Applicant, to invest in a tile business run by him and his family members. However, the payments made by the complainants, as detailed in the FIR, were allegedly diverted towards cryptocurrency transactions. When the complainants demanded the return of their money, the accused persons failed to do so. It is alleged that out of a total amount of INR 55,00,000/-, only INR 7,50,000/- has been returned.

6. Counsel for the Applicant submits that the Applicant has been falsely implicated and that he is not even a beneficiary of the money alleged to have been induced from the complainants. He is ready to join investigation.

7. Mr. Hitesh Vali, APP for the State, on the other hand, submits that the Applicant is equally culpable, as he, along with the others, is alleged to have cheated the Complainants by inducing them to make payments to co- accused Mr. Junaid Sabri (brother) and Mr. Ali Sabri (nephew).

8. Upon a pointed query of the Court, Mr. Vali, on instructions from the Investigating Officer, confirms that the Applicant is not a beneficiary of the alleged amount. He further confirms that no Settlement Agreement has been executed between the Applicant and the Complainant.

9. Having regard to the aforenoted facts, the Applicant is directed to appear before the concerned Investigating Officer tomorrow at 04:00 PM and render full cooperation.

10. Let the status report be filed before the next date of hearing.
