This is a special leave to appeal under Section 378(4) Cr.P.C. filed against the judgment and order dated 13.09.2023 passed by the learned Judicial Magistrate, Khatima, District Udham Singh Nagar in Complaint Case No. 703 of 2017, Manoj Garg Vs. Sanjay Goyal, whereby, the respondent accused was acquitted of the charges under Section 138 of the N.I. Act.
4. Issue notice to the respondent no. 2 returnable within six weeks, enabling him to file objections, if any, to the application to leave to appeal.
5. Summon the LCR.
