The respondents were convicted under Sections 342/354/506 IPC. The respondents were sentenced to undergo rigorous imprisonment for 6 months under Section 354 IPC, 6 months under Section 406 IPC and 3 months under Section 342 IPC. In addition, the respondents were also imposed fine of `1000/-, `500/- and `500/- respectively for these convictions. The respondents were to further undergo rigorous imprisonment for 1 month in case they did not pay a fine of `1000/- and 15 days each in case of default of payment of fine of `500/-. The respondents had impugned this order by filing an appeal before the appellate Court. Conviction has been maintained, but the respondents have been granted benefit of probation.
Counsel for the petitioner very vehemently contends that the appellate court did not apply its mind to the case properly and it is not a fit case for releasing the respondents on probation.
I have perused the judgment passed by the appellate Court.

The Court has considered the age and antecedents of the respondents and thus, found that it is a fit case for their release on probation. I would not find any justification to interfere in the impugned order. The revision petition is, accordingly, dismissed. However, total fine as imposed is enhanced to `10,000/-, to be deposited by all the accused persons, which shall be recovered and utilized towards the costs of the proceedings.
