Mr. Babul Choudhury, P.P. HON'BLE THE CHIEF JUSTICE MR. SANJAY KAROL Order 09.07.2019 The appellant has prayed for the following reliefs:
"(I) Admit this appeal.
(II) Issue notice upon the respondents.
(III) Call for the records.
(IV) After hearing be pleased to consider
the evidences on record and to convict the accused respondent Nos. 2 to 7 under Section 333 of IPC for fair ends of justice as those accused persons i.e. the respondents Nos. 2 to 7 are illegally acquitted by the Ld. Court below or remand the case to the Ld. Trial Court, for de-novo trial.
(V) To pass any other order or orders as your Lordships may deem fit and proper". It is heartening to note that with the intervention of the learned counsel appearing for the parties, whose efforts, the Court fully appreciates, all disputes inter-se the parties, stands amicably resolved in the following terms:
"Today, on 09.07.2019, at about 1 pm, in the High Court Bar Library in presence of Mr. Purushuttam Roy Barman Ld. Advocate, Mr. Anupam Paul Ld. Advocate, Mr. Samarjit Bhattacharjee Ld. Advocate and Mr. Kawsik Nath Ld. Advocate, the 1st Part and 2nd Part sat together to discuss and resolve the pending dispute arising out of Crl. Appeal No. 21 of 2018 pending before the Hon'ble High Court of Tripura.Page 2 of 2
After threadbare discussion between the 1st Part and 2nd Part, they have been able to amicably resolve the dispute that resulted in filing of Crl. Appeal No. 21 of 2018, on the following terms:-
The 2nd Part has expressed sincere regret for what happened between the 1st Part and 2nd Part and the 1st Part with spirit of forgive and forget accepted the sincere regret expressed by the 2nd Part and condone the actions of the 2nd Part. The 2nd Part hereby gives assurance, that there will not be any bitter incident in future. The 1st Part has not taken any compensation from the 2nd Part for the aforesaid resolution. The 1st Part also undertakes to withdraw the Crl. Appeal No. 21 of 2018 pending before the Hon'lbe High Court of Tripura, in pursuance of the above settlement."
In view of the intervening developments, the appellant does not press the present appeal. As such, the present appeal stands disposed of, as not pressed. Pending application(s), if any, also stands disposed of.
