1. The challenge in the present petition is to the order dated 09.11.2017 (Annexure P-7) passed by the Appellate Authority, whereby the impugned order of punishment dated 22.12.2015 (Annexure P-4) has been set aside and the disciplinary Authority has been directed to issue a show cause notice giving details of damage to the stocks and consequential loss to the Corporation and proposed amount recoverable from the petitioner and then pass a speaking order after giving him personal hearing.
2. Learned counsel for the respondents submits that in compliance with the said order, the petitioner has already been issued a show cause notice dated 17.04.2020, to which he has already submitted his reply dated 1 of 2 ::: Downloaded on - 14-03-2024 20:52:03 ::: Neutral Citation No:=2024:PHHC:033346 2024:PHHC: 033346 CWP-12901-2018 (O&M) -1- 235 28.06.2020. However, no final decision has been taken as yet.
3. In view of above, let the competent Authority shall take a final decision on the said show cause notice dated 17.04.2020, after considering his reply dated 28.06.2020, and after affording an opportunity of personal hearing to the petitioner, within a period of three months from the date of receipt of certified copy of this order.
4. Disposed of in the above terms.
5. Needless to mention here that if any adverse order is passed against the petitioner, he shall be entitled to challenge the same in accordance with the law.
