Heard Mr. R. S. Mazumdar, learned senior counsel for the petitioner and Mr. Rajiv Sinha, learned ASGI, appearing for the C.B.I. Aggrieved by the order dated 25.06.2015 passed by learned Additional Sessions Judge-I-cum-Special Judge, C.B.I., Dhanbad in connection with R.C. Case No. 4(A)/2014-D, by which the discharge application preferred by the petitioner has been rejected, the petitioner has filed this application.

It appears from the allegation that there was a demand of Rs. 10,000/- as bribe made by the petitioner from the Assistant Commandant, CISF for allowing smooth cutting and lifting of scrap from structure No. 9, Paharigora Station, Lodna Area, sold by M/s. BCCL, Dhanbad through e. auction. On finding the allegation prima facie to be true, a raid was made pursuant to which the petitioner was caught red handed while accepting the said demand of Rs. 10,000/-, which was recovered from the pocket of the trouser of the petitioner.

Since there is sufficient material to suggest the demand and acceptance of bribe by the petitioner, which has been properly considered by the learned court below, I am not inclined to to entertain this application, which is accordingly dismissed.
