As per the office report, the sole respondent, Subrajit Khandual, is not served as he shifted from the given address.
The petitioner, Sakshi, filed a petition for divorce under Sections 25 (iii) and 27 of the Special Marriage Act1, 1954, at an earlier point of time. The respondent, Subrajit Khandual, filed a petition under Section 22 of the Act, for restitution of conjugal rights, which was at a later point in time.
The proceedings in the two cases may continue in accordance with law, and will be decided on the basis of the evidence led.
Recording the aforesaid, we are not inclined to proceed with the present transfer petition and, hence, the same is dismissed.
Pending application(s), if any, shall stand disposed of.
