12 07-07-2014This Appeal under clause 10 of the Letters Patent has been preferred by the writ petitioners against the order dated 8th October 2012 made by the learned Single Judge in CWJC No. 5874 of 2009.
The appellants have challenged the appointment to Class IV service in the Civil Court of Gopalganj made pursuant to the selection process commenced in 1997.
Patna High Court LPA No.832 of 2013 (12) dt.07-07-2014 5/5According to the appellants, some of the selected candidates were not the applicants in 1997. Nevertheless, they have been selected. The information received by the appellants also discloses that some of the persons selected have not mentioned the date of their applications. The learned Single Judge has dismissed the Writ Petition. Therefore, this Appeal.
The learned Single Judge has considered the contentions raised by the petitioners-appellants. The learned Single Judge has recorded that the persons concerned were in the interview list of 2004. That presupposes that their applications were already filed and that they had not filed the applications some day later.
In view of the finding recorded by the learned Single Judge and in absence of the Civil Court, Gopalganj, as party respondent, the Appeal does not merit interference.
Appeal is dismissed in limine.
