For respondent no.1 The petitioner alleges that her passport has been unauthorizedly seized by the Enforcement Directorate and has not been released for last four years. She further says that her mother is suffering from carcinoma and as such she intends to visit her for which her passport is required. The petitioner therefore seeks direction for consideration of the representations made by her and return of the passport.
Considering the present situation and that the passport cannot be released without the matter being heard finally on affidavits, I am of the view that justice will be subserve if the representations made by the petitioner, respectively dated 20th June, 2016, 23rd October, 2016, 23rd March, 2017, 27th January, 2020 and 15th May, 2020 as given in prayer (a) of the writ petition be considered by the Assistant Director, Enforcement Directorate, 2 Kolkata who is presently dealing with the petitioner's case. The representations should be disposed of within a period of three weeks from the date of communication of this order to the concerned officer. Needless to mention that the petitioner shall be granted an opportunity to represent her case either physically or through virtual process at the hearing before the officer concerned while the representations mentioned above are disposed of.
The writ petition and the connected application are disposed of without any order as to costs.
Urgent Photostat certified copy of this order, if applied for, be delivered to the learned advocates for the parties, upon compliance of all formalities.
