FACTS
The matter is called for hearing today dated 26.9.2011. The parties have not appeared before the Commission. Hence, it has been decided to dispose of the matter on the basis of material on record.
2. In RTI application dated 24.7.2010, the appellant states that on 5.12.2008, he had made a miss call from his Mobile No. 94461-48218 to the mobile phone of a friend and the music tone of his friend's phone was copied to his phone. He had preferred a written complaint to SDE, Vatakara, but no action was taken on his complaint. In this connection, he had filed a RTI application on 24.7.2010. This was responded to by CPIO vide letter dated 16.11.2010. The first appeal filed by the appellant was disposed of by the Appellate Authority vide order dated 24.11.2010.
3. In the appeal memo filed before this Commission, the appellant had alleged that the CPIO responded with delay of 83 days in providing him the requisite information and he has pleaded that action be taken against the CPIO.
4. In view of the allegation made by the appellant, notice may be issued to CPIO to show cause why penal action should not be imposed on him u/s 20 (1) of the RTI Act. This notice is returnable in 05 weeks time.
5. The matter is adjourned to 25th October, 2011 at 1040 hrs. The CPIO is directed personally appear before the Commission with his written representation, if any.
