Section 329(1) in The Orissa Municipal Corporation Act, 2003
(1)It upon any such inspection and examination as aforesaid it is found that the drain, ventilation-shaft or pipe, cesspool, house guilly, water-closet, privy, latrine or urinal or bathing or washing place is in proper order and condition, and that none of the provision of this Chapter has been contravened in respect of the construction or maintenance thereof, and that no encroachment has been made thereupon, the ground or portion of any building, drain or other work, if any, opened, broken up or removed for the purpose of such inspection and examination shall be filled in, reinstated and made good by the Commissioner.
