The present petition has been filed for regular bail under Section 439 of Code of Criminal Procedure in FIR no. 267 dated 09.10.2010, under Sections 420/467/468/471/201/120B IPC, registered at police station city Barnala.

I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Barnala dismissing bail application filed on behalf of the petitioner.

It has been contended by learned counsel for petitioner-accused that he has been continuing in custody since 11.10.2010 and however, the case which is triable by Magistrate has not been concluded so far.

Bail application has been opposed by learned counsel for respondent-State, on instruction from ASI Naib Singh, on the plea that petitioner is involved in one other FIR of similar nature.

However, it has been contended by learned counsel for the petitioner that he is on bail in that case.

The factual position has not been disputed by learned counsel for the State.

There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.

Hence, keeping in view these facts and without expressing any opinion on merits, the instant application for regular bail filed on behalf of Sukhwinder Singh is allowed.

Bail to the satisfaction of learned trial court/Duty Magistrate, Barnala.
