5 19-12-2023Vide order dated 23.05.2023, prayer for anticipatory bail application on behalf of the petitioner no. 4, namely, Bhunesh Pashwan, has already been dismissed as withdrawn. Patna High Court CR. MISC. No.26777 of 2023(5) dt.19-12-2023 2/3
2. Heard learned counsel for the rest petitioners and learned A.P.P. for the State.
3. Vide order dated 10.10.2023, legible carbon copy of the case diary alongwith postmortem report in connection with Chhauradano P.S. Case No. 299 of 2021 from the court of learned Sub-Divisional Judicial Magistrate-VI, Motihari was called for but from perusal of the office notes dated 30.11.2023, it appears that the case diary was received but postmortem report was not received to this Court.
4. In compliance of the aforesaid order dated 10.10.2023, a Letter No. 209 dated 24.11.2023 has been received from the Judicial Magistrate-Ist Class, Raxaul at Motihari, East Champaran. From perusal of the aforesaid letter, it is evident that there is no postmortem report available on the record alongwith the case diary.
5. After perusal of the present case, it seems that the present case i.e., Chhauradano P.S. Case No. 299 of 2021 dated 15.11.2021 has been registered under Sections 188, 147, 148, 149, 341, 323, 324, 326, 307, 332, 333, 353, 379, 337, 338, 290, 427, 171(C), 171 (H) of the I.P.C. and Section 126 of the R.P. Act and the present case has not been registered under Section 302 of the I.P.C.

6. Vide order dated 02.12.2023, a report from the Superintendent of Police, Motihari, was called for as to whether any person has died in connection with Chhauradano P.S. Case No. 299 of 2021 or not. If any person has died in the aforesaid case, send a report alongwith postmortem report to this Court immediately but from perusal of the office notes dated 18.12.2023, it appears that the same has not yet been received to this Court.
7. Considering the same, office is directed to send an express reminder to the Superintendent of Police, Motihari, to send a report as to whether any person has died in connection with Chhauradano P.S. Case No. 299 of 2021 or not. If any person has died in the aforesaid case, send a report alongwith postmortem report to this Court immediately.
8. Put up this matter two weeks after winter vacation under appropriate heading.
9. In the meantime, interim protection granted to the petitioners (except petitioner no. 4), vide order dated 02.12.2023, shall continue.
