Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in Sonepur (Hajipur) Rail P.S. Case No. 02 of 2014 registered for offence punishable under Sections 302/201/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that they have been made accused only on the basis of suspicion raised relating to some money dispute. It is submitted that the wife of the deceased had also stated that the petitioners had threatened the deceased. Learned counsel submits that the body of the deceased had been recovered from the railway track and the postmortem report shows many injuries including fracture of bones of the Patna High Court Cr.Misc. No.22079 of 2014 (2) dt.16-06-2014 2/2 arms, hips, skull, facial bones etc. It is submitted that on query made by the police to the Doctor who conducted the postmortem examination, it has been opined that injuries may have been caused due to rail accident. Learned counsel submits that on the date of occurrence prior to the body being recovered, the mother of the petitioner no. 1 had lodged FIR against the deceased alleging that he had tried to kill her when she had asked for return of Rs. 35,000/- which she had given and was not being returned by the deceased. It is further submitted that the petitioners have clean antecedent being father and son and the petitioner no. 1 is in custody since 20.03.2014 whereas petitioner no. 2 since 21.03.2014.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran in Sonepur (Hajipur) Rail P.S. Case No. 02 of 2014.
