                                    O R D E R (O R A L)

Per- JUSTICE NARENDRA KUMAR JOHRI, MEMBER [J] Learned counsel for applicant and learned counsel for opposite parties are present.

2. Heard the parties.

3. Learned counsel for applicant has submitted that applicant is a Senior Public Prosecutor (Group 'B' officer in SER) in South Eastern Railway. He had requested for inter zonal transfer from South Eastern Railway (SER) to North Central Railway (NCR). The Ministry of Railways vide its letter dated 23.10.2025 passed the order to transfer the applicant from SER to NCR.

4. Despite of the order of the Railway Board, the Authority, SER has not transferred him, therefore, vide order dated 19.01.2026 the counsel for opposite parties seek the opportunity to file instruction from the authority.

5. Learned counsel for opposite parties submitted that due to non- availability of reliever the applicant could not be transferred as it is evident from the letter of Dy. Chief Personnel Officer, SER dated 04.09.2025.

Learned counsel for applicant has submitted that at present two competent persons, Mr. Paritosh Rai and Biplav Sen are available as panel lawyer and the authorities has approved the posting of Mr. Paritosh Rai to perform the duties at Ranchi Railway court and Shri Biplav Sen in Purulia court, therefore there is no bar to relieve applicant in compliance of the order of the Railway Board dated 23.10.2025. Learned counsel further submitted that since the validity of NOC regarding the transfer of the applicant is time bound and has life of six months only the same is going to be completed by 30th January 2026 and if the decision is not being taken regarding the relieving of the applicant the purpose of NOC as well MANORDigitally signed by as transfer order passed by the Railway Board shall become infructuous. 7. Learned counsel for opposite parties has not opposed.

8. Having considered the above submissions and availability of two competent Public Prosecutors, we direct to the concerned authority of South Eastern Railway (SER) to take appropriate decision on the representation of applicant dated 09.12.2025 within seven days with regard to relieving of applicant positively.

9. Accordingly, the O.A. stands disposed of.
