[1] Learned Amicus Curiae states that despite efforts, he has not been able to contact the appellant, therefore, is not in a position to state as to whether the appellant is desirous of seeking conversion of the claim petition from under Section 163-A to Section 166 of the Motor Vehicles Act, 1988 in view of the claim petition having been dismissed on the ground that the income of the deceased was more than ` 40,000/- per annum. [2] In the circumstances, the appeal is dismissed at this stage with liberty to the appellant to move an application for restoration of the same, if so, advised. Resultantly, all CMs stand dismissed.
[3] Copy of this order be sent by Registry to the appellants at the last known address.
