(Judgment of the Court was made by Mr.Justice S.MANIKUMAR) Challenge in this appeal, is to an order made in W.P(MD)No.4752 of 2008 dated 19.12.2009, by which, the Writ Court quashed the seniority list of Elementary School Headmasters, Karur Panchayat Union, as on 01.01.2007, issued by the Assistant Elementary Educational Officer, Karur, the 2nd respondent therein, fit for promotion to the post of Middle School Headmasters.
2.It is the case of the 1st respondent/writ petitioner that in the said seniority list, he should have been placed at serial No.25 instead of 35. He has also prayed that consequent to revision of seniority, he should be promoted as Elementary School Headmaster, with effect from 18.06.2001.
3.Upon considering the rival contentions and material on record, vide order, dated 19.12.2009, in W.P(MD)No.4752 of 2008, the Writ Court quashed the seniority list, in so far as the writ petitioner is concerned, and consequently, issued directions to the respondents 1 and 2 therein, to refix the seniority of the petitioner. Being aggrieved by the same, the District Elementary Educational Officer, and Assistant Elementary Educational Officer, Karur, have preferred the present appeal.
4.On this day, when the writ appeal came up for hearing, referring to the letter dated 09.05.2011 of the 1st respondent/writ petitioner, addressed to the District Elementary Educational Officer, Karur, Mr.V.R.Shanmuganathan, learned Special Government Pleader, submitted that though by impugned order dated 19.12.2009, the Writ Court himself has directed re-fixation of seniority, in the post of Elementary School Headmaster, in the said letter, dated 09.05.2011, the 1st respondent/writ petitioner himself has stated that it is suffice to give him, promotion to the post of Middle School Headmaster as per the Priority List, 2011, and that he would not seek for monetary benefit. It is the further submission of the learned Special Government Pleader that the writ petitioner has also stated that he would withdraw the writ petition, if promotion is granted.
5.Learned Special Government Pleader further submitted that subsequently, vide orders, in Na.Ka.No.1307/B3/2011, dated 27.12.2011 of the District Elementary Educational Officer, Karur, the 1st respondent/writ petitioner was promoted and posted as Headmaster, Panchayat Union Middle School, Sevanthipalayam, Karur District. Supporting the above contention, he has produced the photocopies of the letter of the writ petitioner dated 09.05.2011 and the proceedings of the District Elementary Educational Officer, Karur, dated 27.12.2011, which shall be treated as part of the record. 6.Inasmuch as the petitioner by his letter, dated 09.05.2011, had relinquished his claim of seniority and also stated that he would withdraw the writ petition, subject to his request, to consider promotion to the post of Middle School Headmaster, on the basis of the Priority List of the year 2011, nothing survives in this writ appeal for adjudication, as regards the revision of seniority of the writ petitioner.
7.In the result, the writ appeal is dismissed. No costs. Consequently, C.M.P(MD)No.3431 of 2016 is closed.
