Section 34 in The Maharashtra Agricultural Produce Marketing (Regulation) Act, 1963

34. Certain disputes regarding construction of rules, etc., about weights and measures to be decided by the Market Committee.

(1)Notwithstanding anything contained in the Bombay Weights and Measures (Enforcement) Act, 1958, if any dispute arises between an Inspector appointed under that Act any person interested as to the meaning or construction of any rule made under that Act or as to the method of verifying, re-verifying, adjusting or stamping any weight or measure or weighting or measuring instrument, in any market area, such dispute may, at the request of the party interested or by the Inspector of his own accord, he referred to the Market Committee; and the decision of the Market Committee shall, subject to the provisions of sub-section(2), be final and shall be deemed to have been given under section 20 of the Bombay Weights and Measures (Enforcement) Act, 1985.
(2)An appeal shall lie within the time prescribed from the decision under sub-section (1) to the State Government or such officer as the State Government may appoint in this behalf. The decision of the State Government, or such officer, shall be final.
