Section 3(2) in The Maharashtra Restoration Of Lands To Scheduled Tribes Act, 1974
(2)Where any land restored under clause (i) of sub-section (1) to a Tribal or a non-Tribal is burdened with encumbrances, then such encumbrances shall be transferred there from and attach themselves to the lands restored to the non-Tribal or the Tribal, as the case may be.
