This writ petition has been filed seeking a direction to the respondents to consider the petitioner's representation dated 03.11.2017.
2.The case of the petitioner is that he has entered into an oral rental agreement for the shop No.9 with the President of Kurumans Mahal and thereby agreed to pay a sum of Rs.300/- per month as rental amount. But the executive members of the madam collected Rs.1,500/- as monthly rent, whereas receipt has been given only for a sum of Rs.300/-, since it is a charitable trust. Without objecting to the same, the petitioner has paid the rental amount from 09.06.2012 to 05.08.2017 and the same has been acknowledged by the Manager of Kurumans Madam. While this is so, one Mr.Arunachalam has been illegally appointed as temporary President, who has demanded to pay a sum of Rs.6,000/- as monthly rent instead of Rs.300/- for the shop No.9. Thereafter, the petitioner sent a legal notice through his counsel on 26.09.2017. But he was assaulted with dire consequences. Hence, he lodged a complaint before the Thiruvannamalai Town Police Station on 26.09.2017 and the Inspector of Police enquired the same and instructed him to settle the dispute amicably and the said Arunachalam assured to reduce the monthly rental amount. As he failed to do so, the petitioner sent a representation on 03.11.2017 to the respondents stating the above facts. Finding no response, he is before this Court.
3.Learned Special Government Pleader submitted that the petitioner was evicted from shop No.9 for the non-payment of rent. Enraged over his eviction, he has filed a complaint before the Thiruvannamalai Town Police Station and the same has already been registered for various offences for the alleged eviction and now it is pending. In the meanwhile, he has sent the said representation dated 03.11.2017 for which, he has no right to do so.
4.This Court, taking note of the fact that the petitioner was evicted from shop No.9 for his alleged non-payment of rent and a complaint has also been registered against him, is not inclined to entertain this petition and the same is dismissed. No costs.
