The M.P. Electricity Regulatory Commission (Fees and Charges) Regulations, 2000Published vide Notification No. 1293-MPERC-2000, dated the 31st August, 2000, in M.P Rajpatra (Asadharan), dated 4-10-2000Notification No. 1293-MPERC-2000, dated the 31st August, 2000. - In exercise of the powers conferred on it by Section 58(e) of the Electricity Regulatory Commission Act, 1998 (No. 14 of 1998) and all the powers enabling it in that behalf, the Madhya Pradesh Electricity Regulatory Commission hereby makes the following Regulations, namely :-General

1. Short title and commencement.

- 1. These Regulations may be called the Madhya Pradesh Electricity Regulatory Commission (Fees and Charges) Regulations, 2000.

2. The Regulations shall come into force with effect from 1.9.2000 and shall also apply to all applications, petitions, etc. pending before the Commission as on the above date.

3. The Madhya Pradesh General Clauses Act, 1897, as amended from time to time, shall apply to the interpretation of these Regulations.

2. Definitions.

- In these Regulations, unless the context otherwise requires, the words and expressions shall bear the same meaning as defined in the Electricity Regulatory Commissions Act, 1998 (No. 14 of 1998) or the Madhya Pradesh Electricity Regulatory (Conduct of Business) Regulations, 1999.

3. Fees on applications or petitions.

- 1. Every petition or application made to the Commission shall be made by payment of the appropriate fee specified in the Schedule to these Regulations.

2. The fees payable under these Regulations shall be paid by means of bank draft or pay order drawn in favour of the 'Madhya Pradesh Electricity Regulatory Commission, Bhopal'.

3. The fees received by the Commission under these Regulations shall be deposited in a bank account to be maintained by the Commission at such bank or in such branch of the Bank as the Commission may direct from time to time.

4. Amendment of the Regulations.

- The Commission shall be entitled from time to time add, amend, alter or vary the amounts of fee payable as provided in the Schedule to these Regulations by an order to be made in this regard.

2. Petition for review of tariff order passed by the Commission 50,000. - (Rs. Fifty Thousand)
3. Processing fee on Distribution/Supply License Application. 1,00,000/- (Rs. One lakh) to be adjusted against fees to bepaid for grant of license in the event of licence to be granted.
4. Processing fee on Transmission License Application. 1,00,000/- (Rs. One lakh) to be adjusted against fees to bepaid for grant of license, in the event of license to be granted.
5. Fees for Grant of Distribution/Supply License. 0.03% the amount billed during the previous financial year inthe supply area of the license, payable initially at the time ofgrant of license, and thereafter annually in each subsequent yearduring validity of the license, by similar calculation.
6. Fee for Grant of Transmission License. 50,00,000/- (Rs. Fifty lakhs) payable initially at the time ofgrant of license, and annual payments of similar amount in eachsubsequent year during validity of the license.
7. Review application/petition for view of order onapplication/petition for grant of Transmission orDistribution/Supply License. 50,000/- (Rs. Fifty thousand).
8. For grant of exemption of license and for processingapplication/petition and review application/petition in thisregard. Fees as may be specified on case to case basis at the time offiling of application/petition or at other appropriate time.
9. Petition/application for approval of standards and codes-  
  (i) Grid Code 10,00,000/- (Rs. Ten lakhs).
  (ii) Distribution Code 10,00,000/- (Rs. Ten lakhs).
10. Petition/application for amendment to Codes/Standards in S.No. 9 above. To be determined on case to case basis, depending on theextent of work involved.
11. Application for inspection of order/ records of theCommission. 100/- (Rs. One hundred).
12. Application for obtaining the certified copies of the orders,directions, decisions and reasons thereof, pleadings papers andother parts of the records of the Commission. 2/- (Rs. Two) per page.
13. Fee on the petitions other than those listed above (As perclause 15 of Madhya Pradesh Electricity Regulatory Commission(Conduct of Business) Regulations, 1999. Rs. 250/- (Rs. Two hundred fifty).
